Cougar Financial and Capital One - DEBT PASSED TO a dca urgent help please

    First of all, I want to stress to you that you must only offer them what you can afford. Don't feel threatened by Cougar,(?) and don't be tempted to try to borrow any money to make up the shortfall. If you are self-managing your dmp, and you can only afford £1.00 to pay them each month, then they will have to accept it, whether they like it or not. A judge will not order you to pay any more than you can spare so please don't worry about hollow threats of court etc.

    Try sending them something along the lines of...

    "I write regarding your letter dated xxxx, the contents of which have been noted. I can confirm that, due to a family member lending me the funds, I am now able to offer £xxxx as a Full and Final settlement of this debt. This is upon condition of the debt being noted as "satisfied" on my credit record and I shall require an assurance from yourselves that the remainder of the debt shall be written off and not sold on to, nor pursued by any other debt collection agency. Please note that this offer will stand for the next 14 days. If your client feels that they cannot avail themselves of this offer, I shall have no choice but to repay this debt by monthly instalments as previously agreed by your client.
    I await your reply"...........etc etc.

    Others to reword/clean up as necessary!

    i offered about 25% last time would people suggest i up this to about 35% (my maximum) in this letter or up the amount more gradually

    If it were me, I would offer the 35% and if they reject it again, offer it to one of your other creditors instead. :D

    Im really scared now receieved a further letter this morning (just after i have sent my second reply!)

    Is headed as from Power 2 contact limited but uses the same address as cougar

    "we have been instructed by our client to visit your address to collect the above debt.

    You have made this action necesddary as you have ignored all their requests to contact them (not true as they have just replied to my first letter) and you have failed to pay your account.

    Our visits can take place during any hours.

    Should you wish to avoid this course of action, you must contact our instructing agent within 72 hours of receipt of this notice :

    cougar financial services

    Faiure to comply with this request may lead to the above action without further warning or notice.


    How can they get away with letters like this one? This has really worried me can somebody reassure me please

    If they visit, which is extremely unlikely, then just tell them "get lost".

    If they won't go, then you call the police.

    Honestly, these people have no powers whatsoever.

    im just getting really annoyed as they are contradicting themselves saying i have never contacted them when theyt have replied to my offer the day previous

    Well, they are lying through their teeth. :mad:

    Not only have you letters from Cougar Financial to prove that you have, it turns out that they are the same company. Just using a different trading name.

    I would be tempted to report their lies and harassment to the OFT.

    it shouldnt have an effect on me like this but it has, im not hiding from the debt i am accepting its my fault and have responded within the timescales required
