Can anyone confirm whether the rumours are true and that the mobile outlet have applied for bankruptcy?

Like many many others I am chasing TMO for non payment. Im weighing up taking them to a small claims county court. Any info will be greatly received.

Not sure if they have gone through but I can't even get onto MCOL either:eek:

Surely they haven't gone bust aswell:confused::confused:

Please can amyone advise what I'm to do now as they owe me (and alot of other people) alot of money:mad:

Can anyone give me some guidence of what to put into MCOL application to start court proceddings against TMO. I have issued the LBA and sent countless emails without any response bar the automated reply. I have also kept all the responses and also had an email back from a Imran Hussain stating " I am away from the office on leave and will respond to your email when I return (Monday 5th November). "

Do I need to go into depth or is is suffice just to point out the fact that they have breeched their own T&C by failing to up hold their side of the bargain?

    Thanks

Time to sit back & wait....
What did you say in your application to MCOL? I love to know that what I'm going to do is correct as this might end up in court and dont want to look a total half wit before a judge and loose my case:confused:

I gave a brief outline of the contract, why I was filing a claim (non payment of successful cashback claim) followed by a chronological list of the attempts I had made to resolve the situation and their responses (if any). The biggest problem I had was making that all fit within the allowed space on the online form, whch can be no more than 24 lines or 1080 characters. I typed it up in MS Word first then pasted it into the form.

That took me about 1/2 an hour to get the wording down to 1080 characters !!! Lets hope everyone that is raising these forms manages to get their dough !!

Thats a lot of £25 fees that TMO are going to be claimed from them. Why has it had to come to this ?!

If you really need more space, then although you can't use MCOL, you can do the claim manually by getting the forms from your local county court, or download them from the county court website www.hmcourts-service.gov.uk

All documents are then hard copies, and sent through the post to the court.

The initial fee is higher (£5 or £10 more than MCOL), but like MCOL, the fee gets added to the claim, and the Defendant has to pay you if you win the case.
