If you want a speedy settlement, one tactic is to offer the bank the option of settling for a lower amount if it pays out now. How much lower depends on you, but 25% less is a good rough guidance. There’s no need to do this, it’s your choice, though if you choose to the letter below is drafted to help. Do note the phrase ‘without prejudice’ I’ve used, it’s crucial. It means that the offer isn’t binding or admissible in any further legal process.

After reading the previous messages I'm now even more unsure of my next step.Was rejected by Halifax on 1st letter - no surprise; ignored on second so wrote to ombudsman and sent a third then offered £2,720 and the cheque arrived this morning. The claim is for £7,438 with charges.so help please - do I bank the cheque and count my self lucky or hold out for Ombudsman's decision in about 2 months. I know I now have some of my loss recouped but after 25yrs with Halifax (closed the account before started claim) would have thought they'd already had their pound of flesh.Any advice, please0

Interesting one. In the county court system, the max is normally £5000 in England. If you bank the cheque for £2,720 that leaves £4718 outstanding.
As you went via the FOB to get this, you still have the option of using the court system. Write to Halifax saying you accept £2720 as part payment to your claim. You then want to know how they calculate the charges which amounted to the balance of £4718. Give them 7 days to respond failing which you will commence court proceedings for $4718 and remind them that you will ask the court the same question.The Winner Takes it All0 -

If you have put your claim through the FO you need to let them know that you have had this cheque and they will deal with Halifax for you as you have requested they do.0 -

I have received a letter from my local court today, ORDER OR JUDGEMENT.
Myself and LLods had to file and serve all our documents by the 18/6, which i did, clearly Lloyds have still yet to, so the court have exteneded their time limit and given them til 11/7 - gutted, as feel they have prompted them and been lenient on them for not abiding by the courts time scale.
Anyway if they do not file and serve by then we win by default.
Has this happened to anyone else, if so what was the outcome??

Since my last post was made, I have received an offer of half of my bank account claim!! (£142.50) of the £291.00 & (£612.50) of £1225.00 before interest. Is it still worth my while going for the whole amount with interest? If so, which is the best route to take, The Financial Ombudsman or straight to court?
Would I treat these as two seperate claims if i take them both to the courts? one claim is £361.00 and the other is £1250.00. There is talk of credit card claims maybe more of a problem getting the whole amount back!!can anyone shed any light on this please.

I've decided to take all 3 of my (OH's) claims to court and have been looking at the MCOL site - the 3 accounts are all with Barclays, one is a current account, one a platinum card and the other a gold card. As they are being difficult I'm claiming the interest too (which takes the total amount claimed to just over £1500).
Can I lump all 3 claims together as one as they are all with Barclays? Or 2 claims as one is a bank account and the other 2 are CC's, or is it best to do them seperately?:j Almost 2 stones gone! :j

Im the same.alliance sent a form saying they are going to defend the claim,and then on the c.a.g site they say I will receive a form "allocation questionaire" and will have to pay another £100 after spending £120 pound already. I am trying to get money back not pay more out.0
