Earth Mobile Ceased Trading can anyone help

  • I have rung my network provider (O2) they were able to tell me that the mobile that I sent to Earth Mobile has not been used since 20 July (the date I sent it to them) which means that they havent sold it on yet.
    I asked o2 to place a bar on the handset, this ensures that if the phone is resold it will not be able to be used as it has been reported stolen. If by any miracle I get it back from Earth I will be able to unbar it.

    I would advise anyone who has a phone outstanding from Earth Mobile to ring their mobile operator and quote the IMEI number to block the phone so others cant use it! I still intend to write to them to try and get my handset back!

    The Dedworth Road one came up as another one where loads of business's being listed there so assume it's another mail box drop and a waste of time probably

  • My son sent his phone off to these a few weeks back, received an email to say they had it and then never got paid.

    I just checked Companies House and there is nothing to say they have gone into administration. Presuming they haven't, and have just stopped trading, is there any way we can all get our money or at least phones back.

    Am I missing something here......

    If Earth Mobile have your phones (you did keep a copy of the IEMI number!) and they go into administration then you should simply ask for your mobiles back.

    As you haven't received payment for them, Earth Mobiles don't legally own the phones. As you phone is uniquely identifiable (i.e. not cash which can be co-mingled) then you should eventually get your phones back.

    You are missing a couple of things.

    1. If they have ceased trading, then presumably they have no staff left to send the phones back. Unless they are a 1 man business, of course.

    2. If they have gone into liquidation/administration, then all phones on the premises that they have accepted ( but not necessarily paid for ) are deemed to be business assets and those who "sold" them stand in line with any creditors such as council, utilities, Tax man, suppliers etc.

    3. Any phones accepted after trading has ceased are a different matter and are NOT assets of the business as they arrived after they ceased trading.

    But how do you get them back?

    Phoned O2 - got the phone blocked but apparently the phones can be used abroad as a UK Phone provider cannot block their use outside the UK!!!

    So where do we get in line to sign for any recompense from the liquidators?

    As GD pointed out above, If you have agreed to a sale to them then the phone will be held by receivers if they are appointed and you will get a percentage of any funds available.( usualy very small though)

    If anyone is in the position where the phone was sent for appraisal and you have not yet agreed a price to sell to them then you are able to request the phone back and the receivers have to return it to you (if they can find it of course)

    The problem here of course is that he would seem to have sold quite a number abroad through ebay and in which case you would be unlikely to hear from anyone

    You will have to wait and see if any are appointed first and then write to them to make a claim.
    As I said earlier I think the clients with the phones still in existance who have not agreed to a sale but sent it for appraisal will stand a better chance of getting their phone back ...if you get my drift ;)

    If this guy is used to sharp practices (and we don't know if he is )
    there might not be any paperwork left to say which sales have been agreed ??? ;)

    lets face it we have been proper ripped off and theres nothing we can do about it, put it down to experence and lets get on with our life.
    i too was ripped off by earth mobile. £105 bucks down, and not a thing i can do about it.
    LETS GIVE UP THE GHOST WE ARE GETTING NOWT!
