Well I wouldn't recommend driving with a axe between your legs you may not have much left if you brake suddenly
What the Op says doesn't make sense to me I think there is more to this then perhaps they are letting on. Again why would police pull them up even if it was for say back light out, would they really notice a mobile between your legs? As I said even if not guilty of using it when driving why would anyone drive with mobile between there legs? sounds odd to me
PS I have one very large axe in my garage, another log splitter and a smaller axe

I've driven all the way home from work a few times with my phone between my legs, if I happened to be using it when I've got into the car. When sitting, my pockets are hard to get the phone into, and I wouldn't want it sliding around on the passenger seat. If I were stopped for some other reason, would the phone between my legs be a potential offence?0

To all the people saying "Show them your phone logs to prove you were not using it", you don't need to be phoning or txting someone to be using your mobile phone.
You could very easily have been writing a txt or reading a txt, dialing a phone number or just messing with the settings. Doing any of these things will make you equally as dangerouse as someone talking on the phone but will not have a log to prove you were doing it, just PC Plod.
As others have said, the police couldn't have seen a phone sat between the OP's legs and from what I can find, it is not an offence to have a phone between your legs as long as it doesn't affect your driving in any way so we have to assume the police pulled the OP over for some reason.
Perhapse the OP was driving erratically and they decided to see why at which point they saw the phone and put 2+2 together. Or perhapse the OP had the phone in his hand when they saw him and quickly dropped it between his legs to hide it. The OP hasn't given enough info to be sure though.
One thing that we can be sure about though is the fact that the OP's wife had just given birth does not excuse the OP from following the law. E.g.
"got stopped by 2 cops while over the limit. Was not drinking at the time, the bottle was between my legs. Wife had just given birth a few hours b 4 after many hours of labour. Apologised to the cops. adrenaline flowing ( they were v arrogant and showed no compassion or unrderstanding) but they were'nt having it. Got banned - not a happy bunny. Is there any comeback (appeal process) there?"
This is a bit more extreme but in this context you can see how the "wife just gave birth" point really makes no difference and doesn't mean you can use a phone while driving.0 -
As a police officer I think the op is telling porkies.
To be pulled over you must of been seen by the officers using your phone or commited a moving traffic offence.
Once pulled over why did you not remove your phone from between your legs before the officers got to your vehicle.
I think you where driving along on your phone then when you spotted the police you done the automatic reaction and dropped it between your legs.
As two officers seen you using your phone then you have no chance if you take it to court or are you saying these officers are not honest.
If you were not on your phone then take it to court, otherwise admit it you were caught so pay up and except the points.
So many people still use their phones whilts in control of their vehicles, this should be atleast six points on your licence.
Then also you get the usaul when people are stopped.Have you not got anything better to do like catch real criminals ? (well yes if i did not have to stop people like you then i could catch real criminals)
You have been seen breaking the law so just pay and learn by your mistake.0 -
If the OP hasn't committed an offence then the OP should not be guilty of an offence.

In which case the OP shouldn't have accepted the fine and should have shown the police his call and message logs at the time and asked them to prove he was using his phone.
I think there is more to this that OP is letting on.
Most likely scenario, officers colleagues in another car saw OP using his phone and asked anyone in the area to pull him over.Accept your past without regret, handle your present with confidence and face your future without fear0 -

Not really - the op, if using a phone whilst driving, was putting other road users lives at risk, I'd say that's more uncalled for than telling them to grow up. As per the other poster they do need to grow up, accept responsibility for their actions and realise that the 'wasted' 5 mins stopped to make a call is worth far far less than someone elses life.
As to being able to 'prove' that you weren't making a call at the time from your bill there are several possibilities to counter that argument :
- Did the cops take the phone no.? If not it could be another phone (work phone etc)
- You could have been dialling and not got through or typing a text message - no real comeback, cops word will beat yours in court.
At the end of the day, take the points/fine as going to court will cost more and chances of winning are slim.0 -

ok - if you honestly weren't using the phone, then on the back of the ticket, there is advice about what to do if you want to contest it.
This will involve you going to court - so prepare to swear on oath and show the magistrates your phone records.
They will want to see call AND text reports to make sure that you weren't using your phone at the time of the alleged offence.
However - the magistrates can still find you guilty if they don't believe you and they could increase your fine....just a word of warning.
