OP - ignore the diabolical advice on here. If your story is correct, then you can appeal against the points and the fine by pleading not guilty.
Anyone else getting really p&&sed off by the judge, juries and executioners who state "nothing you can do" without any qualification other than a hefty dose of self-righteousness.0 -

I will give you a very constructive comment.
Although i am happy for the addition to your family,on the 15/03/08 my brother was involved in a car accident where the driver was not concentrating on the road,ok he was not using his Mobile but not concentrating whilst using your mobile is an offence.
He sustained in the accident
Fractured c-6 in the neck
Fractured t4-t5-t6 in his back
Difuse axonal brain injury,with shearing effect
That happened almost two years ago and he is still in a brain rehabilitation unit.
So i guess the Moral of what i am about to say is concentrate on your bloody driving,if you need to make a call pullover if you dont pullover to make your call and get caught,tough.
By the way the driver of the other car had a broken wrist,he was charged with Careless driving and got a £100.00 fine with a £15.00 victim surcharge,and was told to retake his test.
My brother will never lead an independent life again.

Sympathies, but not at all relevant. Not using a mobile at the time and OP was not charged with driving without due care.

Sorry to hear about your brother, but the OP has quite clearly stated that he wasn't using his phone; he just had it between his legs.
I didn't think it was against the law to put your phone there, and it's a better place to put it than the parcel shelf where it can slide about.
One does wonder why the police stopped them if the phone was there the whole time. I mean you wouldn't see a phone in someone's car normally if it was between their legs would you?
As Tozer says, they can surely appeal if they wish. I'd be interested in the police's side of the story though. I mean they'd look real foolish to stop someone for using a mobile phone when they couldn't actually see one, only to find that the person didn't have a phone.If you don't stand for something, you'll fall for anything0 -

Quite correct,i should have not made the assumption and i apologise to the OP.
I cant help myself seeing these days people who use mobiles whilst driving,although my brothers accident had nothing to do with a driver using a mobile careless driving is a very broad offence,and it aches me to see people using them knowing what can happen.
People think it wont happen to us,but your wrong it does,i know full well looking at my brother who for eight weeks was in a coma in the John radcliffe in oxford,it can happen.
its easy to make a call whislt on the move,its also easy to take a life maybe not killing the person,but as i said Christopher will never lead an independant life again.

in brief ..
got stopped by 2 cops. Was not using the mobile but was between my legs. Wife had just given birth a few hours b 4 after many hours of labour. Apologised to the cops. adrenaline flowing ( they were v arrogant and showed no compassion or unrderstanding) but they were'nt having it. Got a ticket with 3 points and & £60 fine - not a happy bunny. Is there any comeback (appeal process) there?

You got stopped by 2 cops - why?
You were driving with a mobile phone between your legs - I doubt that this is an offence.
You apologised to the cops - why and what for?
What did you get a ticket for?
If you were charged with using a mobile phone then as others have said then it is easy enough to prove that you were not. If you had been then - tough. You did wrong, got caught and paid the (small) price.
