Fed up to my eye teeth with Bankers and Politicians over the past few years, is it not about time we had a place to bank where greed was not so rife. we are being blackmailed to have our salaries paid into banks seemingly because of convenience. It's people that I read about on this website who pay 1/3 towards banks so others can have free banking is it not about time a bank was approached who would deliver to their customers reasonable charges for unauthorised overdrafts therfore bailing out on the parasite banks out there. Times are hard the Banks are feeling it too...0

hi there.
i have just recieved a letter fromnatwest stating that they were doing nothing wrong with the charges and therefore would not berefunding the money back.
they also state that if they do not hear from me within the next 8 weeks they will regard the complaint closed.
what would you recommend my next step be?

A. They have eight weeks to deal with it and it's likely they'll be swamped. When your case is dealt with, it's likely to be thrown out if your argument was based on the premise of the OFT's original case, that the fees were disproportionate.
Yet there is nothing stopping you complaining a second time based on the potential new legal arguments and you can always complain to the Ombudsman if you don't like your bank's response, and this is especially worth doing if you fit any of the Ombudsman's special criteria (see below).
It appears they are about to throw your case out based on the decision of the Supreme Court last month.

Hello,
Same type of letter received yesterday the 30th of Dec from A & L. The date on the letter was December 2009 without a day on it, so I am sure as far as they are concerned the 8 weeks starts on the 1st of December.
Shall I respond to their letter just to let them know that I do not agree with the decision and to be within the 8 weeks window?

I submitted a claim at the back end of 2008 on behalf of my girlfriend (she doesn't deal with financial matters well herself, hence over £2000 of charges she was claiming) and it was put on hold for the OFT case.
She has not had any rejection back yet however im sure this is in the post. My question: i believe there is a case to have some portion of the charges refunded on grounds of hardship, is there any definition of "hardship"?, what criteria would you need to satisfy for this or is it all done on a case by case basis?
It's the Abbey National who the account is with.0 -

Can I clarify if it is with the courts or the bank(on hold that is)?
Financial hardship is based on household income and expenditure so if your household is in hardship then you may be able to ask the bank to consider if they believe a refund of charges is appropriate. The bank have to treat you fairly and sympathetically under BCOBS and examples of what the bank can do is in the Lending Code.0 -

It's with the bank, on hold. Is there any guide yet for below what level of income consitutes hardship?

i have done this with my bank and they did nothing i asked them to send out a form so i could prove this and the reply they sent was that there was no proof that my charges had put me in hardship0
