  • rang the Register and gave them the general gist so hopefully there will be something on that soon.

    also rang apple to register my displeasure at how they were treating their customers (didn't mention not getting the camera, just complained about getting lied to etc.) they offered me a goodwill gesture and a discount on a future order but I didn't accept, would prefer to see how this pans out.

    On the other thread people were warning me that someone may take my comments as legal advice. I am clarifying my position... I am a student studying law and therefore I cannot give professional advice. If anyone does want to seek legal redress they should probably consult a legal practitioner.

    I hope bad-head-day that you won't be using "loss of bargain" purely from what I have said. To get embroiled into legal "mumbo-jumbo" ;) would not be too wise (since they've got many Latin terms they can fling back at you ;) )

    I just sent an email of complaint to the addresses provided, but within minutes both bounced. Not quite sure what to make of that.

    Anyway, there certainly is a contract as we received the order confirmation. From their ToC:

    '"Contract" means these terms and conditions together with your Order Confirmation;'

    Anyone defending Apple or disagreeing with complaining think of this; had the boot been on the other foot, Apple or any corporation would not have hesitated to screw us.

    with 15% off it's a good price I guess but it's available on the high street for £450 (London Camera Exchange) and even in jessops for less than £494 (apple price).. it's £420 from dixons using discount code at the moment though..

    What is the price over in the U.K.? I think it is a good deal in Ireland (although the D50 has been supplanted by the D70)

    hmm.. I keep getting the same response "we're out of stock and we're in our rights to cancel due to terms and conditions" although originally they said it was a pricing error.. they just won't budge.

    From my understanding if there has been a misrepresentation (legal term for a lie... kinda) made then exemption clauses like 2.6 do not operate.

    I'll re-iterate that I'm just a student and my understanding may well be wrong (also I'm stating Irish law which may or may not be different to English law in this instance).

  • Its not just the Olympus that Apple are cancelling, myself and a friend ordered the Canon G6 at £199 on the 30th Dec, had the confirmation, money taken from our bank accounts, and today the order was cancelled due to "no availabilty".

    So best of luck to all complaining, maybe the people posting "forget it" will now realise that its not just the Olympus issue

    If anyone doesn't mind they could post up e-mail templates.

    So people can just copy and paste and e-mail it.

    The ones I have sent seem alittle un-structured, so if anyone who is more literate and doesn't mind posting there version, that be appreciated. I'll post some later when I get some time to construct some well written ones.
