  • I haven't been reinmbersed as of the time of this message. Money taken on the 30/12/05 (actually taken, was reserved on the 29/12/05).

    Regarding the link to online articles about this matter, all very interesting articles. However, none of them make mention of the fact that Apple actually took our money.


    I'm no legal person, but I always understood that a contract was formed when 'money changed hands'. Feel free to correct me on this though.



    One interesting point I would like to make though is that having been a regular Apple Education customer I am well used to their document system when placing, tracking, and receiving orders. What happens is this



    1. Order placed - ACKNOWLEDGEMENT email received

    2. CONFIRMATION of ORDER email received

    3. SHIPMENT NOTIFICATION (dispatch & tracking information) email received

    4. Goods arrive at my house.



    And that has ALWAYS been it. However, for an order I placed at the end of December (which has arrived) I today received



    5. INVOICE email



    Never had one of those things before.



    The interesting thing is that during a telephone conversation with Apple (my brother, not me) Apple told him that although they had completed 1 & 2 above and taken his money, still have his money (but they will refund it), as no invoice has been issued the contract has not been completed.



    Apple obviously thinks this new document (called an invoice) will give them more protection.

    No refund put on my switch card yet. I discussed this with consumer direct who were helpful but didnt seem that clued up on all the laws. Unlike my local Trading Standards Office who told me i have every ground to sue for ''los of bargain'' (that is to sue for the amount it will cost me to buy it elsewhere at full price as they are in breach of contract). If they still do not provide the camera after a final letter stating my postition and intention to sue, i will take it to the small claims court and let them decide. I wouldn't be doing this unless the trading standards officer (who is impartial) had assured me that i have a very strong case against them. ...I have a really good feeling about this!!!!

    Well just to see what they'd say, I called yesterday too. I got the same line. I was told that the E-1 was not being made anymore. I, of course, told them that Olympus said differently (going by what I've read here). He want off to his supervisor and came back with "Yeah, well Olympus told us this morning that they aren't making it anymore" </paraphrasing>

    All in all I'm really not bothered by anything except the lies - Olympus mailed me back this morning. I got a good giggle from that.

    Apple really keep digging a hole on this. Admit the truth and apologise. It'll go a long way - lesser so the longer you hold out.
  • I got one better than that from Olympus... they also said there are no supply problems:

    Why are you all skirting around the edges of this by sheepishly asking if Olympus have "stock" - this won't get really interesting until someone asks them if they can supply one or two thousand of the buggers. An affirmative answer to that would change everything. Until then, we haven't got a ball game :)

    Has anybody who called apple and challeneged this noticed how the call starts to be recorded when you mention legal action????

    well my letter is now on its way to the ceo apple uk ..hollyhill industrial estate cork ..
    republic of ireland....

    so if apple keep to form i expect to hear from them sometime never....lol

    but im still taking satisfaction that somone high up in apple somehwere will be wishing that this little fiasco would just go away and it may be this rather than over indulgence of turkey that will be the main source of indigestion for sometime to come.
