Flimber wrote:Why are you all skirting around the edges of this by sheepishly asking if Olympus have "stock" - this won't get really interesting until someone asks them if they can supply one or two thousand of the buggers. An affirmative answer to that would change everything. Until then, we haven't got a ball game
The staffer I talked to came back with (from his supervisor) "Olympus have told us this morning that the E-1 is discontinued". My actual question was is the camera current and available in bulk quantities - I should have sent it from my business account, that might have gotten a better response.
Again, it's the lies that annoy (bug? I'm really not that annoyed) me. Not not getting the camera.0 -

I don't understand what you are saying. Olympus has confirmed the E1 is still in production. Which means stock can be increased if needed. However the main point is that it means Apple has lied and that they would have no choice but to fulfill the contract as it would mean the ToC they used to exempt themselves from this would not apply anymore. The camera is still being made, therefore they would be able to source stock. What don't you understand.

That is interesting, I believe Apple are sensing the pressure. Or maybe that was an existing function. Either way, good job mate. Be careful what you say though. I believe the ball is in our court.

i would like to know Martins opinion
There are 2 sides to all the posts on here so far, people who genuinly ordered the camera, who are students, and their money was taken
and people looking for a bargain
Nothing wrong with either of the above
But where most people are cheesed off is that their money was taken. that is the most important part in this
Yes everyone knows there was a limited chance of this coming off, and it hasnt - its one of those things
But to have money taken from you for 5 days and not be given the goods, that is unforgiveable, and no explination from apple or anything regarding this, which is what got my back up
I noticed that i have been refunded this afternoon, but for them not to communicate is the poor part of the story.

If they still do not provide the camera after a final letter stating my postition and intention to sue, i will take it to the small claims court and let them decide. I wouldn't be doing this unless the trading standards officer (who is impartial) had assured me that i have a very strong case against apple. To take a company or individual to the small claims court doesnt require a lawyer and through these ''whining'' posts i am able to gather ideas and approaches which may or may not strengthen my case. However, my trading standards office will be seeing my case before it is submitted."
Obviously from reading the past 48hrs of posts, there are some who want to challenge Apple and their statement that the camera in no longer made. Following the email from olympus Uk stating that the model is still in production, they have technically lied about this in order to refund all purchasing contracts. (and not yet refunded the money!)
I do not like being lied to. yes it was most certainly was a pricing error (no concrete proof) but the onus is on Apple not to allow purchasing. They did not have an effective failsafe in place, therefore they are liable to provide the camera according to contract.
What we all need to do is:
1. get a valid email address for senior management in Apple.
2. all complainents send an agreed email stating the complaint and sourcing of the camera.
Only then will be able to put pressure on apple to supply the goods they are contracted to supply.
Is there any TS or legal people using this site? if so can you let us know what are chances are if we have to make a legal representation.
All those who are unhappy with apple, help each other out and we may get a reasonable result. If you are not interested or want to leave un-constructive advice/ comments then please post on another thread so we can try and work together.
All this coming and going is like banging your head against a brick wall.
I am doing to leave this same message on MSE to see what happens.

the last few posts here have been spot on. I think that the way that this thread has run is simply down to the fact that being lied to in the way that we have is just not acceptable.
My letter went off in the post tonight to apple, Hopefully a few others will also follow through in making our feelings known directly to apple.
Intersestingly if you use google and do search under the news banner with just the term apple. you will see that the top two stories concern this matter. I cant believe that this fact is sitting too well with apple at present. At sometime in the near future if and only if the pressure is maintained apple will have to say something. Im not sure how we can all pull anymore together on this issue than what we have done and has already been suggested..
Weve manged to make it news worthy. Weve hopefully lodged out concerns with the bbc watchdog site and weve written to apple directly . Until apple responds to our mail then there is very little else i think we can do . The ball is in thier court .
I want to thank everyone who came along on this ride... people who genuinely put a sense of moral injustice above getting a percieved bargain.0 -
Will this end up in The Sun or any of the daily papers?
I hope so!.0 -
