  • Hi Guys,
Does anyone know what I can do to miss out on a payment or make a reduced payment for one month? (a really reduced one) This month is Christmas (I guess no one heres not feeling the pinch on that score), BUT I have to go back to Ireland for it, AND I'm moving jobs at he end of December. I just can't pay this month, but should be able to return to paying in January. TBF I have paid back nealy 2000 since the 31st of August... Will I get in trouble and will Payplan allowed it?

    Thanks,
    DL x

  • Hi
i spoke about a ccj - cc from barclaycard is o/h but the ccj in my name. update filled in ccj dispute and have had a reply form court today.

I acknowledge receipt fo your defence. Acopy is being served on the claimant (solicitor). The claimant may contact you direct to attempt to resolve any dispute. Ifthe dispute cannot be resolved informally, the claimant will inform the court that he wishes to proceed. The court will then inform you of what will happen.
Where he wishes to proceed, the claimantmust contact the court within 28 days after receiving a copy of your defence. After that period has elapsed the claim will be stayed. The only action the claimant can then take will be to apply to a judge for an order lifting the stay.

    Q what is stay/stayed?

fINANCIAL OMBUDSMAN gave me a telephone number for barclays- barclaycard head office to make a formal complaint 0800 282 390

I have spoken with them it turns out that barclaycard had sold two account of o/h onto other parties with false information ie incorrectnames etc . So much for data protection.
Told that they would investigate and there would be no court case.
But this was a week ago and have not had anything in writting as yet.

    Hi TC,

I Googled to find a definition of Stay, this link looks useful: http://www.duhaime.org/LegalDictionary/S/Stay.aspx

    Quote from above website:

"A stay of proceedings is a stopping or arresting of a judicial proceedings by the direction or order of a court...; (a) a kind of injunction with which a court freezes its proceeding at a particular point, stopping the prosecution of the action altogether, or holding up some phase of it.
A stay may imply that the proceedings are suspended to await some action required to be taken by one of the parties as, for example, when a non-resident has been ordered to give security for costs. In certain circumstances, however, a stay may mean discontinuance or permanent suspension of the proceedings.”

    Hope that helps!:D

  • Hi, I started my DMP in October, including a credit card with BoS (AA branded). My September statement showed zero interest, so I thought they must have agreed to freeze interest and charges. Then, the October statement showed "interest at a reduced rate", which was about 2/3 of my DMP payment. I got the November statement today, together with a letter stating I had missed a payment (the amount was my DMP payment amount) and the interest was back to full wack - totalling about 125% of my DMP payment!!!:confused: And a nice fat £12 late payment charge to boot!

Surely they know cccs pay on 25th of the month, so why the threatening letter and the charge? My balance is now going up

I've emailed cccs to ask for help, but if anyone else has had dealings with BoS/AA, would be grateful for any advice!

Hi all, reposted - got my Scottish banks mixed up - this is a BoS CC.

I am worried because an annual fee (ironically CPP Credit Card Protection) of £29 was charged to the card and wasn't bounced (surely the account must be frozen????) - I had completely forgotten that I paid this last year using a cc and didn't know they could just dip in and take the money this year too

I am worried they are no longer taking my DMP seriously - do you thnk I should make a payment to cover the £29? I know I should run this through CCCS but I waited 4 days for a reply from them and all they said was "which card do you mean?" so I'm now waiting again for an response:confused:

Any advice from you guys would be very welcome :o

Rabbit - Have you tried asking your card issuer what is happening? Why the change in interest rates?
With regard to the missed payment - this happened with me on one of my cards, and when I phoned them up, they said "don't worry about it - the letter shouldn't have gone out - we can see that your payment comes in on the 25th, just ignore it" - put my mind at ease straight away and without having to burden CCCS with yet more of my problems....!!

It might be worth giving the card issuer a quick call....They will actually be able to tell you what's going on - CCCS can only make a judgement based on their experiences - whereas the card issuer will be able to actually tell you.

Whilst you're on the phone, you can also ask them to remove the late payment charge as they have agreed to the DMP and they know when the payment arrives.

It's worth a try, isn't it...? What's the worst that can happen??

  • Thanks Dizzie,

I admit I am really nervous about speaking to my creditors, that's the main reason I went to CCCS as they said they'd do all the negotiating:eek: .

My other excuse is that I thought CCCS would not allow me to make an additional payment to one creditor, but I guess there is a good reason for it...

I'll try to psych myself up to make a call.... Hot tea and a biccy needed urgently!!:o

They also don't like additional spending on credit so I can't see the harm in making this small payment. (Only my opinion mind). There a thread here called Ask a CCCS Counsellor a question. It's worth asking on there then it's confidential and should be a quick answer.

  • Hi there, just a quickie question. One of my creditors on my DMP is yorkshire bank they sent me a letter saying i have to pay within such n such days then another letter came yesterday to say i have not responded to them so they may pass debt over. Anyway day before i had spoke to someone at YB and he put a halt on charges for account for month whist he waits the CCCS proposals which i said had already been sent. But they have def been sent already and first payment as just been paid. Anyway CCCS said the proposal was sent to collecting office at leeds and the yorkshire bank letters where from glasgow its looks like on their letter. So was going to ring CCCS to tell them this but i though YB leeds would have just passed it on to the right place. YB who spoke to on phone said they will take further if dont receive this proposal, even though they have it somewhere!!! Any advice for best thing to do?

Also, oh just realised this isnt a quickie after all.:rotfl: I had a loan years ago with my ex through AA loans and it got passed to blair oliver and scott. Ive paid this for 5 years with them and was still on going all through blair oliver and scott up until the new DMP, then last week out of the blue got a statement letter from AA loans saying what balance was and the last few payments id made and one showing for this month which is wrong cos they had token payments so dunno where this came from. Anyway this statement said by law they had to start sending statements out wth balance etc but ive not dealt with these for 5 years at least cos was sent to BO and S so cant understand why they would send it. Anyone else had any experience of this? And what they are up to cos got me confused? Didnt know if they were just trying it on or something.
    thanks in advance

    Hi Mummy!
The same situation as I had with the proposal letters going to a different department to the one who does the chasing...! In my case it was Goldfish, but CCCS will have sent the proposal to YB as long as you have given them the details. Have you got your breakdown from CCCS? You can tell YB how much they've been allocated -which shows them that it is all in hand.
The proposal letters will get put onto your account eventually, but don't expect YB to let you know when they've received them - they'll only hassle you while they don't have them!

As for the statements, that is normal too - I got one from NR this week too, it's nothing to worry about (unless the amount outstanding is vastly different to what you think it is...).

    Hope this helps?

It is a bit nerve wracking, but if they have agreed the DMP, then they can't really hassle you for more money (cos you don't have it).
They are a bit more reasonable when you are at least trying to make the payments - as they can see that you're making the effort.

Be Strong! What's the worst that can happen? You'll put the phone down because you'll feel uncomfortable with the questions...
what's the best that can happen? You'll have your interest rate dropped totally or vastly reduced, which will help you clear the debt sooner!!! :T
