PtP have threatened to call my workplace despite my requesting them not to if I do not have phone contact with them. They refuse to put anything in writing as well. Debt companies are allowed to ask for evidence, but you are within your rights to just send them another income and expenditure sheet, they have to take your statement at face value - probably why they like telephone contact to find holes.0

Now you have mentioned that you DONT pay the excess as your MIL is being nice and not asking for it.
If I didn't have to pay my excess, then my SOA would be amended to £400.01 benefits and £400.01 rent as I don't have to find the excess out of my other income as I am not actually paying it.
Hope this is clearer? You should only include on your SOA the actual costs you are paying each month (rather then what you 'should' be paying)

Take a look through there and if there is anything they have done that the shouldn't quote the above and state what they did to break it. Put in writing with FORMAL COMPLAINT accross the top. If they have broken the guidelines don't forget as well as just complaining put in the letter what you would like them to do, ie, stop interest, refund charges, accept plan and refrain from telephone calls.0 -

Thanks I think I understand, what you are saying is that on my SOA I should state my Incapacity Benefit is £385. and not £300?

I really do need to get these off today, just had a letter in mail from Nationwide Credit Card to say if I dont make arrangements to clear the £93.35 they will instruct KRP Debt Collection to recover the outstanding ballance (£1,602.) and another from Aqua Credit Card to sayI am severely in Arrears and its under review by arrears dept.:eek:0 -

I wrote to you on <date> advising you of my current financial difficulties and asked that, for the time being, you suspend any interest and service charges on the account. I also stated clearly that I wished to deal with this matter by written correspondence only.
Since then, I have had no direct response from you and I am disappointed to see that a further £xx in charges and £xx in interest has been added to the account.
Furthermore, in spite of my very clear, unambiguous request, I have this week been pestered on a daily basis by telephone calls to both my home and mobile numbers on your behalf from an organisation calling themselves RMA. <... or whoever...>
I now formally insist that all further correspondence be made in writing only.
I demand that these phone calls stop immediately. I am familiar with the terms of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997 and I believe the harassment from your agents places you and your agents in breach of these acts.
Take note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.
You will be deemed to have been served notice of my request and I will consider it served by <date - a few day after posting>. Any calls received after this date will be recorded with the intention of them being used as evidence.
These telephone calls are in breach of the Office of Fair Trading guidelines. If your agents continue with them after the receipt of this letter an official complaint, together with a log recording the times and frequency of the calls will be passed both to that office and to the Trading Standards office.
Furthermore, calls to my mobile telephone occur during working hours and I am therefore at my place of employment. Calls at this time constitute harassment on your part; and are an attempt to put undue pressure on a debtor by attempting to embarrass them at their place of work.
ANY further telephone calls to my place of employment will result in a formal complaint being raised with relevant authorities. This will be relevant to questions of your fitness to hold a licence under the Consumer Credit Act, whether or not it results in a prosecution.

No thats not what I am sayingBasically just leave off the rent completely then, much like I leave off the Council Tax as mine is covered by council tax benefit and I dont see it.
If you DONT actually PAY the £85 then it shouldn't be on the SOA.

Welcome Bristoldebt, it's great here!
I know it's easy to say don't worry and chances are you won't stop worrying, but things will settle down. When you first enter the DMP it can be a little mad for a few weeks, but once the creditors realise you are doing what you can to pay the debt and you can't offer them anymore than the sum stated, they will back down and you will find you have days and sometimes weeks with no contact from them.
Also, for now, don't worry about the interest. It is scary at first, watching the debts escalate (spelling?) but this happens to everyone and again, it will stop eventually.
