  • Im confused by waht you mean on you have written off the equity in the house.

have you sold the house? Are you alredy divorced and in your divorce you have agreed on 50%?

If you have sold your hosue recenlty, and done something with you half, even if it has gone to your ex wife, the OR is likely to slap a BRO on you, and £50k is a lot to give away!

Please explain. When you go BR please can you let us know what the OR allows, it may help people inthe future.

I think kev meant he doesnt give a dam as he was going to lose it to his ex anyway

Although thats gonna be one annoyed ex when the OR comes a knocking:eek:

I have written off the equity in the house. Either as part of a divorce settlement (too late now) or as part of BR.

I now live in a rented property as I have done for 2 years.

One issue I don't know the answer to is how the OR judges the variable income I have. Sometimes I am on call, sometime I do overtime and then again I may have to take a new contract that pays half what I am on now.

Kevin, you'll still have to come up with your share of the equity, either by selling the house, re-mortgaging, or someone buying your beneficial interest from the OR. If your ex-wife got more than her fair share in the divorce the OR can undo that.

Oh I see. that makes it clearer, I thought the divorce was done and dusted.

Hopefully your ex [STRIKE]vulturess[/STRIKE] sorry, wife will have to wait the 3 years, I'm sure the OR won't let you pay her as it will reduce the amount he can take in an IPA.

You really sound like you've been taken to the cleaners, wrung out and put back in for a second wash.

Gotta say, I feel for you with the ex wife thing. As your ex, especially with a good income, she can support herself but is taking your money for the sake of it. I hope you know not all women are like this and are happy to stand on our own 2 feet!

I hope the OR says she cant have any! But I know you are thinking about your children and them having a nice house to live in etc.

Question is will my ex-wife have to wait 3 years for any spousal maintenance (this is not child maintenance, I will never not pay for m children) until the IPA/IPO is done. Otherwise I will be paying for marital debts through my BR and then penalised twice by paying SM. As I've mentioned ancillary relief is a topic on its own outside of my BR.

    Kevin

Thinking about it, wont they base the SM on your available income in July? if your IPA is in place your disposable income will be greatly reduced, so she'll get a whole heap less than she's expecting.

I've never heard of spousal maintenance! I don't think I would accept SM if I got divorced! As Lindsay says, not all women are like that.
