    Hiya,i cant see the burlington on page 6 having trouble only finding one page,what am i doing wrong?help!:confused:

    i had to phone them up today as the extra sheet i ordered with my mattress didnt turn up and instead they sent me a pair of sandels :rotfl: the cs lady i spoke to was very helpful she said the 10.00 code would be credited back to me once my order is delivered and also confirmed delivery for mattress was going to be around the 12th june, so hopefully its all gone thru ok.
    i think i got different mattress to a lot of you as mine was £25 odd.

    fingers crossed we all get them as it is a great deal. :D
    have now given up smoking since feb 13th 2014 loving the money I'm saving

    NO stores do NOT have to sell you stock at the displayed price!!! This is wrong!

    Tim I'm afraid your wrong on this one. Goods on display in a shop window / pictures in a catalogue / leaflet etc are known as an Invitation to Treat in the law of contract and for a valid contract to be in place there has to be a valid offer and acceptance by both parties on all material aspects of the goods. This includes the price. You the consumer make an offer to the seller to buy the goods at the alloted / displayed price which the seller does not need to accept and thus does not need to sell you the goods.

    It's a common misconception that the "consumer" is entitled to the goods at the displayed price when alas indeed they are not and it's good will of the shop letting you have them at the lower / misprice no matter how much you stamp your feet and say I know my rights (alas most consumers don't but then again a lot of retaillers don't either and this is often why you get them at the cheaper too.).

    Case law as follows for the law students amongs us:-

    Pharmaceutical Society of Great Britain v Boots Cash Chemists (Southern) Ltd [1953] 1 All ER 482 (Goods on display in a shop with the price attatched was not enough to be deemed an offer).

    Fisher v Bell [1961] 1 Q.B. 394 (Flick knife in shop window case)

    Does the fact that they have taken the money from my account mean they have agreed to sell me that mattress at that price?

    No. Please see their terms and conditions, which you accept by placing an order.

    Ther is also a fair bit of case law on 'obvious mistakes'.

    Well if deducting the dosh from my bank account doesn't count as having accepted the offer I'll whinge.
    Have to say though sometimes you can understand Companies getting tough on these deals when people strong it.

    I ordered the one I need at this time but we all know some of these will be shunted directly onto ebay for profit.
    Spoils it for the people who just genuinely need to get a bit of spine relief IMHO.

    You missed the most obvious bit...


    They haven't taken the money from pickledtink's bank account. They have reserved the funds in the account pending despatch of the order. However, if they do not despatch the order within a certain time frame, the funds will become available to pickcledtink. So, the money is still in pickledtink's bank account, but pickledtink cannot access it.
