Financial difficulties/hardship case

Hi i am currently trying to help my mother out, she is with Yorkshire bank and whilst i worked out all her charges last june and sent the letter to the bank the case was put on hold and she is still recieveing charges daily on her account. In total last june she had around 7k of charges and my dad recently lost his job so that money would be very handy right now. Last week he did get back to work but they now have mortgage arreas of 3 months and are struggling to pay that back and make the normal day to day payments for cills etc. I would like to help them ask for their case to be considered as a hardship case but cant seem to find much information on how to dela with yourkshire bank or any particuar way to apply for this. Has anyone had any luck?Saving needed to emigrate to Oz*September 2015*

I am on garuanteed pension credit as I am unemployed and 64 years old, my wife is on pension as she is 60 and receives 11p per week, yes that is correct 11p per week until I reach 65.
As I read this site it appears that if your account is serviced entirely by benefit payments , as our is, it is illegal under the terms of Social Security Administration Act 1992 to impose charges but I wrote to HBOS and quoted this and they replied, received this morning, that the act does not cover charges for returned DD. Our money is calculated so that we pay DD on certain dates to fall in line with our weekly payment. EDF who have taken their money opn 20th of each month for the past 12 months put in a request for payment on 15th one month which meant it was the day before our money reached our account and as a result the DD for Elec & Gas was returned and the bank charged us £70. I asked the bank to take this over 2 weeks payments but they refused and took it in one week which meant that another DD was returned and further charges were added which meant that again a DD was returned and so it has gone on and short of cancelling all DD s to get us square what can I do? Is HBOS correct that the act does not cover these circumstances? From where can I down load a copy of the Act?
Any sensible advice would be gratefully accepted.0 -
I sent nat west the hardship letter as I am on incapacity benefit. they in turn sent out a financial statement for me to fill in & return which I did.
A week later I got a letter asking me to call them. I called on Tuesday this week and was advised that I am not a hardship case, if I go overdrawn they will still knock me £38 a time and the woman also threatened to remove my cash card (until she realised that was wrong and then backtracked hastily).
I have only had 4 or 5 charges all in the last few months, before that I had run the account with no problems for over 15 years and at one point also had a business account with them as well.
Should I complain or go straight to the court stage?

My sister has applied to the Abbey to have her charges refunded under the hardship clause. She has written to them twice and on both occasions they have sent her a photocopy of a sheet saying that the case is on hold. They seem to be totally ignoring the fact that she's claiming under the hardship clause as they have not referred to it in any correspondence. WHat should she do now?0

This is exactly the same with HBOS, they continually send back a letter stating that all decisions are on hold and enclose a pamphlet outlining their complaints proceedure, hence my email to the FO. They avoid answering my question about their failure to comply with The Social Security Administration Act of 1992, as mentioned on this site.0 -
I have phoned the FO who confirmed that the action that HBOS are taking is contrary to the Social Security Administration Act 1992 and are sending me the complaint forms to take up my case on my behalf, would it help if more people did this thus putting pressure on the banks?0

My sister has other income other than her working and child tax credits. Could she still make a complaint?0

Sorry but I'm new at this...I heard something about being able to over-ride the wait for reclaiming bank charges if you are a "hardship" case. i have already submitted my form letters and have (finally) been acknowledge by Lloyds TSB but have not files through the courts. can anyone advise me regarding this hardship case? Thanks0

I sent off a letter asking for £160 in charges, But got a letter back about financial hardship, There want me t fill in forms abouts my wages, what i pay out, i.e. phone, fares,gas,water,elec!
and then will knock now my current account to a basic one and set up a dd for my loan!
has anyone else had this? seems a little odd for £160!
