It does sound as though you have a case for hardship, you will need to send in a full financial statement, and HSBC are quite difficult at the moment to claim from, so your hardship case needs to be spelt out to them as strongly as you can.

    after weeks of arguing over the phone and being past from pillar to post i eventually had to go through my current incomings and outgoings , today i recieved a call offering me £200 !!

    i kindly declined the offer as it is laughable .

    so onto the next stage then ................................
  • HSBC must be one of the worst banks going for everything (sorry about the rant but in 2008 I had to complain so many times about them and they still did nothing). Anyway they rejected my dad's claim for hardship even though he clearly meets the criteria as he is constantly over his overdraft and getting £200 of charges a month. This was due to him spending nearly a year in hospital in 2007/2008 and not having time to build up his account before everyone started taking their payments again. So I've now passed the matter to the Financial Ombudsman. If they come back and say no then fair enough but the way I feel about HSBC I'm not believing a word that comes from them.

  • Hi all, I wrote to Halifax and claimed hardship, they wrote back and wanted proof. I sent them a copy of my statement from the CCC showing how much my debts are are how much I can afford to pay (minimal), but they wrote back eventually and said they didnt think I qualified. can anyone tell me what I should do next, if I can do anything at all :o(

  • First, my husband is out of work and I have sent all the paperwork to claim back charges they did put £750 in my account as a 'goodwill gesture' can I go on to claim the rest under 'hardship'?
    Also since putting in my claim I have occurred some more charges, can I re-apply for these?
  • Success to be reported. After sending info to the FOS I had a letter back to say they could do nothing till HSBC sent a letter saying this was the next course of action. So I sent a letter to HSBC asking for this. They called my dad on Monday and after being passed round a few people they offered him £725 out of just over £1000 of charges. They have also waived charges that are due to be charged. I am so happy and wouldn't have been able to do it without all the lovely people here. Thanks you.

    Im new to this so here goes !!!!
    I read that if you are always over your overdraft limit cos of bank charges and you have more than £500 in charges over a period of ayear then that is classed as financial hardship, i have £793.00 in charges so hope that i can go ahead with my claim for that reason.
    Can anyone tell me if they have managed to get a result from this same reason,

    Remember to read the FSA Waiver on Bank Charges, PAGE 11 (its on my signature). One of the criteria which states "could" indicate financial hardship is £500 per year. I would look and see if any other criteria exists. I think you need to look at whether you have priority debts that you are behind with, ie mortgage/rent, gas/utilities etc,etc
