Financial difficulties/hardship case

Hi , I recently sent a letter to the Bank of Scotland to ask for my case to be dealt with straight away as i feel i fit the hardship criteria under the FSA's waiver rules.
I received a letter back today with part of it saying - "our initial assesment of your case has not revealed any clear signs of financial difficulties with ourselves or others to support this claim and therefore have decided to put my claim on hold"... "however we recognise we have limited insight into your individual circumstances".
they included a form with the letter with the heading -
MAT/BBA Common Financial Statement [v3]
..which they ask to be filled out and sent back if i didn't agree with their assessment.
I have done this to the best of my ability but i was wondering if there is a template to save time which can be sent with the original letter stating hardship and perhaps a guide to filling out one of these forms (like the guide on filling out the complaint form to the ombusman)?
I am on income support due to an injury to my shoulder and i am unable to pay any payments to two debt collection agencies (one of which is chasing me for charges incurred on my bank account that i was unable to pay) as all my money coming in is going on neccesities such as food etc.
Will this qualify me as hardship? I read somewhere that if you haven't actually been taken to court over money owed then you will not qualify for "hardship" can anyone tell me if this is true?

No template due to each claim being individual to the claimant as is the hardship criteria to each bank so you need to fill in the form as they ask and hope they will look at your claim along with looking at your financial situation.
As techspec says this does not mean that they will pay back your charges but that they are obliged to look at your claim and if their decision is not to your satisfaction you can then refer to the FO.0 -

Hi,
We incurred most of our bank charges before March 08,when we were £2100 OD and picking up more and more every month.My husband was then made redundant with a hefty payment that we used to pay this and other debts off. Despite him taking 5 months to find another job and claiming JSA we are not in financial hardship now. His new job is lower pay and we have a 2year old,so we get tax credits and I receive incapacity benefit and DLA. Can we claim under the hardship rules because we get benefit,or do we not qualify? I do want to nail Natwest because they made our life a misery till we got this money,but do I have to join the queue with everyone else.

Hey all,
I filed a reclaim request with HSBC for £958 of charges and cited financial hardship as after paying my rent, my loan repayment etc I am left with around £50-£100 per month money to live off.
Today I had a reply saying that they can't process my claim due to the FSA hold but that they have logged it and should the FSA release the hold it can be processed.
It went on to mention that as I cited financial hardship, they have enclosed a form I need to fill out called 'Putting your finances in order' - they basically want me to tell them all of my income / outgoings by phoning them once i've worked everything out on the form.
Is this the normal process for reclaiming under hardship with HSBC? I'm a bit confused at this as I thought the rule was that if you've had over £500 worth of fees in the last year they should look into your case as a hardship circumstance; I have had £850 of them!

I am student and last year had a pretty awful time with llyods tsb involving going over my overdraft.I am now in a very awkward position and I don't know if should try and send a claim in for financial hardship.can someone please help me?
I have no parental support so I relied on my student loan and overdraft to see me through the term. I went over my overdraft by 53p and automatically got charged £35 per day and from there everything spiraled out of control.
Unfortunately at the time when I tried to claim back the charges the case had just gone to court however my complaint had been logged and they send me regular updates to the case.
At the moment I am having to live in Leicester to continue with uni work and have looked all summer for a job to be able to pay my bills and only on saturday managed to get one but now I am stuck with huge bills to pay for rent, phone, insurance, credit card and the interest on my accounts keep going up every day!
Do you think I have a case for financial hardship?0 -

After reading the info about reclaiming bank charges I submitted my claim to Lloyds TSB. I recieved the letter regarding the test case and let it be. I am currently finding it difficult paying everything off and the claim I have in with Lloyds would help me out alot. This has all happened since being made redundant last October and finding a new job with less pay. Can I resubmit my claim under financial hardship?0
