  • Hi...sorry to hear you're in debt....we are too and it's not nice is it?
    We've just set up a debt management plan with Payplan and I've just sent a letter to Lloyds warning them of court action if my case isnt dealt with immediately because the FSA has put a waiver meaning that all hardship cases(people like us!!) must have their cases dealt with.

  • Hi forum new poster here.

    I have been in contact with my bank (BARCLAYS) in connection with a claim to get back my overdraft charges and I explained I was claiming income support

    The bank have replied saying although they realise I am experiencing difficulties financially they will not be refunding my charges.

    What can I do now? Am I just expected to sit and wait another two years while they sit on my money money that they have stolen from me?

    i think you can write to the financial ombudsman because i think if you are in financial difficulty i dont think the bank has a choice but to proceed with your claim. Im probably wrong though hopefully someone more experienced will come along shortly. You could always ring the FO and ask them before you send letters off.

    Are you getting confused with the totally incorrect views that charges against people on benefits are illegal?
  • what consitutes a "hardship" case to reclaim unlawful bank charges?
    I own a pub, and am owed over £6000.00 in bank charges!
    my pub is struggling to make ends meet at the moment, and the brewery have threatend me with bailiffs if i dont start paying the money i owe them back!
    can i go to court and ask for this to be heard as a hardship case?
    any advive would be greatfullly received!

    Tozer who are you asking me or the op? if that was directed at me then i never said the charges were illegal i have just heard that if a person can prove financial hardship the stay on these cases can be lifted.

    I was under the impression that if you stated that your money was made up of benefits that you could reclaim your bank charges immediately and wouldn't have to wait until the outcome of the court case. Is this so?

    My sister is currently entering into a DMP and has tax credits. She's is particularly in need of extra money at the moment and so has started the re-claiming process with Abbey. She has paid nearly £500 in charges since January. She's had a letter stating that she has to wait for the outcome of the court case. She telephoned them this morning stating that she was in receipt of benefits and entering into a DMP and that she was claiming these charges back using the hardship clause but they told her that didn't exist. What should she do? ANy advice for you knowledgable folk would be most appreciated.

    Hi....we're in an identical position in the fact we've just set up a DMP and we recieve tax credits etc and have just sent the final letter to Lloyds warning them I intend to go to the court if they dont get back to me in 7 days.....
    Just wanted to say tell her to go for it and not be fooled by what any bank will try and fob you off with....Go for it ;) and good luck :beer:

    Thanks. The reason I'm questioning this is that I read on the 'Bank charges success stories' that someone has managed to get their charges paid because of these reasons.

    The amount she's been charged is £485 and it would be a massive help to her right now.
