    am on income support and have just had to pay 125 in charges this month they are taking a further 150 i asked them to reconsider and have had an email to ring to discuss!!!! will let you know how i go on will ring tuesday with hsbc by the way in the past i have just had a straight no they will not refund test case blah blah blah

    Open a different account for your benefit to go into. Come to some arrangement with the original bank to pay back £5 a week or so until the charges stuff is decided.

    You need to start by asking the bank, not the court, if they will look at your claim as a "hardship" case and if they won't look at it then you can ask the FO to consider your claim as a "hardship" case.

    Hi All,
    I'm in the process of claiming back all my charges. I've written to Yorkshire Bank with a spreadsheet of all the charges I'm claiming and the letter that Martin has on here. I've received a letter back from the bank today thanking me for the information but they mention in the letter about "having financial difficulties" and they suggest I see a debt councillor. They have also enclosed a leaflet about dealing with debt. They have asked me to list all my incomings and outgoings and say "Please provide us with details of the changes in personal circumstances that have lead to this unfortunate change in your financial position."
    I'm now some what confused as I wasn't expecting this, I was expecting either no we're not paying you anything or to come back with a small amount.
    But what do I do now?
    Write back and say they didn't understand my letter, which was the same letter on here or write with all my outgoings and incomings?

    Think that will be a NO, then.

    Move on to letter 2.
    I all have learnt is from others on many sites.
    Seek legal help if unsure.
    Dont pay Private Parking tickets - they are mere invoices.

  • i have recently downloaded and mailed the recliam letter to A&L. i included the part where the funds were being taken from government income (working family tax credit) and that i was on a low paid wage (i only work part time). they have sent a letter back asking for a full income/expense breakdown including my husbands details. the account is only in my name, do i have to fill this in? i only have 14 days to reply or they are assuming i no longer wish for a reinbursement. :confused: please help some1

    If you want your claim to be considered due to financial hardship, then yes the bank will ask you these details while they determine if you are a hardship case. Have a read of the first post in this thread.

    It sounds like they may be considering your claim for charges in the light of fianancial hardship. You could send them the information they have requested and then follow up with the second letter, if you don't get a positive response.
  • I am currently trying to take my bank, the Royal Bank of Scotland to court and seek a claim for the return of charges and interest. In 2005 my wife died of Breast Cancer. I was left at home looking after three children under 18, plus our two other elder children at University. I had to give up my full time job. I was unable to keep up the payments on a Car loan of 16K ( unsecured that they happily lent me) and asked for their advice, given my personal circumstances. The bank did not reply for several weeks, and then phoned to suggest that I should take out a re-mortgage on the property with themselves. However, on reviewing my now much lower income, turned this down themselves ! leaving me with the same interest charges and no offers or solutions as to how I could proceed with paying smaller sums. Instead they kept rolling on the charges and interest charges. They have now rolled this up to a massive 24K and issued a county court notice against me, asking for a charge of 8% to be added to this as well.
    In return I am seeking that the court throw this out on the basis that I had advised them of my personal position, had asked them for help and advice, and had sought a longer term of payment and lower repayments to which they were unable to respond. On top of this I was made redundant in January of this year. So they have also been trying to get from my Job Seekers Allowance the full whack of interest charges from my very miserly income.
    I have previously been earning in excess of 40K pa and for five years nearly double this. I had built up a good credit record and had no previous debts. They have now seen fit to try and destroy all of this. Any advice ???

    I've moved your post into this thread as the bank really should have dealt with your claim as a "hardship" case. I would now get in touch with the FO and see if they can help you.
