The same thing happened to this guy I know, he had 2 complaints with the same company (Welcome Finance) comes to mind.
One was under Gisc and the other was not, the FOS returned both the complaints, and this guy had got in touch to inform them that he hopes they realise that at least one of those complaints they were under jurisdiction (GISC), the FOS taken a look and then realised this.
So he is having that one looked again at least anyway, but for us to do their jobs of telling them this is wrong and it is down to the FOS to check this out.
I'm sure they have a list of who and who wasn't covered ??
I did not realise that the reason our settlement was so high was to do with this insurance premium being front loaded and only getting a little back. They always blamed it on rule 78. I even mentioned rule 78 in my complaint. I probably should not have done.
And i certainly did not know that the reason again was that interest was payable on the whole loan term and not just the 5 years.
I just knew something was terribly wrong and now i know that the settlement was because of the insurance. I hope they get it this time.0 -

It did say that if i had further evidence then please get back by 14th July. I did not argue as the only thing that would have changed it is the GISC thing and they should have known that they were under GISC from November 2001.
I feel so annoyed now. I have only just read the letter again and its states my complaint for unfair settlement at 2003.
Its not my situation that has changed, its that they have not looked into their jurisdiction properly i think.
I would feel annoyed too....... .
So basically what they are saying is that they were not covered when you settled in 2003?, and yet they were covered by GISC ?
How long ago did you do this complaint, was it that long ago ?
I bet your kicking yourself !!!:mad:The one and only "Dizzy Di"0 -
Hi All
Have been going through my claims at mom and what has been settled and outstanding and though I would post a summary.
I have decided to settle with B/Card and FOS because this has been going on since April and the amount of time I am spending checking figures and arguing is not worth it. This may not end here as I have other ideas which I will share as and when I can.
CC Charges reclaimed:
A/L£110.00,
B/card £88.00,
Morgan Stanley £48.00,
Capital One £72.00,
Lloyds £90.79.
PPI On Loans: Barclaycard Loan - £4795.34 Settling,
Lloyds x 3 - with solicitors.
PPI On Credit Cards: MBNA - £3,500.00 from FOS being settled
With FOS awaiting Adjudicator: - Been there since FEB(this year) Tee Hee
MBNA - approx £1000.00,
Barclaycard approx £4000.00,
Lloyds - approx £1500.00
Bank Charges Barclays £150, Lloyds OH , Joint and mine about £1600.00 on Hold.
Phew. That feels better. Started all these last October and should be settled by this October.
Am in from garden now, but noticed sun is out again so may pop out again. Keep knocking spiders down with my broom and the horrors keep going straight back up and building more.:mad:0 -

Its not new though its still my old one. Wording must come into it. They know what people are complaining about and we are legal bodies so why mess us around like this.

The wording is the main issue I think, and they should really deal or have dealt with your complaint anyway it they were covered by GISC, that's my opinion, and I also think this depends on who's desk this may land on too.:rolleyes:The one and only "Dizzy Di"0 -

This is what i asked for any help on here from. Is the unfair rebate issue a GISC thing?? Is it an insurance complaint or a banking complaint and when they were registered with the FSA.?? We really need to find this out.0

Hi hun, I know this can be very frustrating and thanks for also reminding me.
I received a letter from the FSCS last week, they would like further information, (more docs) although I do not have anything else to give really and they just wanted to know how this product was sold, which was by phone.
I have been told the one dealing with this will contact me tomorrow as I had informed them of my lack of paperwork, really its only something to confirm the name of the company in full but only had the trade styling name of the documents I already sent them which did not state TWOPART limited on, so have only come across underwriters paperwork for this, hope this will do.
And they also confirmed that TWOPART/Eloan are NOT in default yet.
I do know though they dissolved in May 2008.
Do you have any idea when Picture actually stopped trading by any chance hun ?;)
No but I could look it up. I do remember someone on here was told they would be in default in a week or two two weeks ago! and tiggrae thought it would be anyday . On the FCSC site it does list companys you can contact them about and Picture is there, is yours?DS1 12/10/04

This is very frustrating, have you anything on your documents that actually state "GISC" on them which you passed into them ?
I know mine was settled in November 2005 which then Endeavour were covered prior to that but still its so damn annoying because if they are covered it should not have really been returned to you.
I do really hope they sort this out for you hun, it just seems so unfair here. The one and only "Dizzy Di"0 -
