  • Hello all,

My wife has been paying for PPI on her Natwest credit card for at least 14 years. She has never previously needed to claim but In January this year was diagnosed with breast cancer and after struggling to meet the payments (due to being on half pay) she decided to claim.

They have now said that because she works less than 16 hours per week (she's contracted to work 15 hours) she is not eligible to claim.

She has changed jobs since taking out the card and reduced her hours after maternity leave 3 and a half years ago.

Anybody think we have a good chance of a successful claim whether it be for the full period of the PPI or since my wifes hours were reduced?

Maybe worth writing to the FSA. If the new firm is regulated - and the directors are "controlled functions" and therefore approved... this may call into question their fitness to hold such status. Its a really really long shot ... but bugs me that they should continue to prosper when they've caused many people knowing misery.

Thanks hun, I will make a point of doing this tomorrow.;)

I have so far emailed both the OFT and Companies House, and already sent in a complaint letter to Click about this, not sure what time you have to browse here but Tiggrae helped with a letter/email for me to sent the compliance manager at Click, they replied to me yesterday to say they will respond in a few days.
(A copy of what I sent is just a few pages away), thanks hun, I appreciate this very much.

Picture are closed to regulated activity but still a firm. Details of their compliance contact are on the FSA web site.
While i'm sure the FSCS will have things in hand - bare in mind that firms wanting to be registered were required to hold PII (professional indemnity insurance) or a guarantee in lieu. So if FSCS can't help - i'd consider going back to what's left of Picture and making their insurers pay!
Thanks for the info, I will keep that in mind. I have sent all details to FSCS last week - still waiting to hear from them. I did send the original claim to Picture and it was returned to me and I was told to forward it to FSCS, as they were dealing with all the claims. I was given the same info in a phone call to picture on Monday, 'everything is now referred to FSCS.' l will see what the response is from the e mail - Hopefully tomorrow, they have been quick with their e mail responses.

Oh hun I am very sorry to hear of this news and hope your all okay, please wish your lovely wife well for me thanks hunni.
Both my younger sister and mum were diagnosed with this just a few years ago and they are doing very well, and sure your wife will do too.;)

Okay now about this claim, this is bad, I know this was taken 14 years ago but you have every right to complain about this.
Was this their final response ?

If you email then i would email it to the complaints email addy and also tell them that a hard copy has been sent as well.

Lets say that you won this claim, if you won through the Ombudsman then the Ombudsman aims to put people back into the position they would be in if they had not had the PPI at all and also add 8% interest too. If you still have a loan most of the time your loan is rescheduled at this point and the ppi is paid back as a cheque. Some companies have been known to offer the refund and then take the money back and repay off some of the loan with it. Either way you are put back into the position as if you never had the PPI. If the PPI is from a settled loan then they generally pay you a cheque.

I am always at a loss as to what to write in letters and emails to such big companies. WOuld I not get much money back then dya think?
    Cheers

Firstly sorry to here of your wifes illness and what a time you must have had and this as well.

You need to get this insurance cancelled if its of no use to you. I would also imagine that they would say that it was up to you to inform them if your circumstances changed but was it something that you actually opted for in the first place?? Or was this applied without your say so?? Was this missold to you in that it appeared on your statements as most people are saying. The tick box ticked by whoever actually processed the card details??

If you want to hun, write a draft letter, add it on here and it can be tweaked.;)
Do not add your personal details on here though hunni, as you know.;)

I am hopeless with letters hun, but we need to be strong, and I have added them on here - the help I have received with the tweaking from others on here, such as Tiggrae, Marshallka, Sarah etc, they have been wonderful.:A .

Just do your best and be strong, add here if you want to okay hun ?;)
