my postie came today to say halifax say yes!!!no liability but as gogw will refund ppi on credit card plus int accrued plus 8%.they say they have not mis-sold to me but will pay anyway!!!!it says they are taking 3 weeks to settle...but no indication of ammount received...
Just to let you know 4 letters to halifax and the complaint form to FOS. I have had no further communication from them advising an adjudicant was appointed etc....
This went to Fos in April this year...
But a great result:beer:
My ppi claim against M and S has been with FOS since Oct 07 and with adjudicant since May 08...so I guess it also depends if the companies want to fight>>>>
Keep the faith out their..And fingers crossed for all your claims and my other claims against Egg and M and S

Nothing brave about it! I thought it was my only option and applied to the courts and later found out that the FOS did cover insurance in 2001 which is different to what I was told at the time which led me to take the court option.
I was successful reclaiming back charges from the Halifax and that needed a court application to go in before they refunded me, but it was refunded within about a week of them receiving notificaiton of my case from the court.
To be honest, I'm surprised they've let it get to this stage as if I'm successful, I'm sure the FSA would take quite an interest in them being found guilty of mis-selling. The fines from the FSA can be huge, so why they are persisting rather than just giving me back my £1600 + £300 in interest I don't know, particularly when I read of so many of their cases being settled as 'goodwill gestures' for so much more money than I'm looking at.Almost debt-free, but certainly even with the Banks!0 -

£85 when I submitted the claim form to the court and a £35 to submit with the Allocation Questionnaire. The hearing is due to be heard by phone - although I would like to attend court given that I am querying the validity of the documentation provided - but this would cost another £200 in hearing costs.
I've tallied up the amount of hours I have spent thus far, and it's roughly 100 hrs from the moment I sent my CCA request, to have to read up on the law, to preparing letters (which they ignored!), to preparing my claim form, to typing it up (all 13 pages), to getting to the stage I'm at now. I've also sent 2 special delivery lettrs, and 16 recorded delivery letters through the course of this dispute.
So, while the official costs are £115, my own time, plus letters and phone calls brings it to about £1000 so far.
I just want to be put back in the same position I would have been had I not been paying into this policy which they never explained the terms and conditions of. I only found out it was useless when I was out of work, desperate and needing it the most. That's the bit that really irks me - happy to take the money over the years but not happy to accept culpability of mis-selling. Hell, their legal team even deny that there is such a legal concept as mis-selling!Almost debt-free, but certainly even with the Banks!0 -
