    Any Tips on the court process....Its just A BIT DAUNTING!!!!

    if you're claiming mis selling then you need to use the Misrepresentation Act 1967 - Negligent Misrepresentation - you can download the statute from the internet - it's only 3 pages long and for a statute it's actually quite easy to read. That will form your particulars of Claim which you'll put down on the County Court Claim form N1 - once you've completed the particulars you either send off to your nearest county court along with the relevant fee or you can submit your claim on line through the county court system Money Claim On Line - it's cheaper but you have to restict your particulars to 1400 words

    Should I try a different route with my enermies....try and get back some since they were regulated???? I was missold in dec 2004, they gave me £30 back..as a goodwill

    Or should I just try the court route...as mine is not for thousands, maybe a couple hundred max...is it expensive to go to court??

    there really isn't another route, the FOS can only look at something from the date an event took place (ie mis selling) which actually took place in 2004 before they came under their jurisdiction, the fact they are under their jurisdiction now is irrelevant to your claim

    but you say they've given you some money back as a gesture of goodwill, was in the form of an offer (ie did you sign an agreement) if you did I suspect it said it was in full and final settlement of any claim against them - so even if you started proceedings they could have your claim struck out - if you didn't sign an agreement then you should be ok to start proceedings

    No heavenlygee, you are not a "clicker". To be in the "click" you have to had a loan from "click". Sorry you cannot join that one. (I don't think you'd really want to anyway - they have gone bump):eek:

    What do you mean by claim again as a "trading as" ?

    About 3 weeks then i got this letter.
    Like if a company is a just a small company but belongs to a big group as Firstplus belonged to Barclays. You can try your claim from the bigger firm and put that they were trading as the smaller firm. Don't know if it works yet but always worth a shot.

    Your claim is with Picture is it not??
    Haven't they already gone into receivership?

    Although nothing has hit the news yet???

    The fscs sent a letter saying with my application that they were still waiting to declare them in default. I was hoping someone on here might have some inside information!!:D

    So can you not go to the FOS then??? Surely one of them must be accepting the claims....

    Postie did come - but all i had was a Sky Mag.......:mad: .

    Have not had the chance to get on with further letters yet, this will either have to be later or tomorrow.

    We have to pick up my son's new car later.;)

    I have no other information from the FSCS only told the same as you Pinknico, and that was by email......:rolleyes: .

    We will keep out fingers crossed, and I know it will take a while because it was also confirmed on the application form letters the other week that they investigate these firms first before actually taking it further about paying out any compo, but at least as long as the firm were regulated when the loan was taken and if the FSCS agrees we have lost out because of this (mis sold), it should hopefully all go ahead.
    Its a time consuming issue, but I look at it this way, if it were the FOS dealing with this, due to their high volumes of complaints we would still be waiting about and at least all is not lost.......:D , well I hope not anyway lol.:beer: .
