    Wondered if anyone can help

    Ive been reading these PPI threads for a while but not sure if i can claim.

    I took out a loan with Barclays about 6 years ago and was told for the amount i wanted to borrow i would have to take PPI a smaller amount and i wouldnt need to. I needed the larger amount £8500 so i took out the PPI. The problem is i got into financial difficulty (the extra PPi wasnt helpling) and the loan went to a CCJ that i am still paying back My question is can i reclaim. Any one any ideas?

    LTSB PPI - £770 ish for dad
    LTSB PPI for dad - £1800 for dad
    Barclays PPI claim for self-£2204
    Dads home insurance - reduced by £200 a year "WE DO NOT LIVE IN FLOOD AREA AND I DON'T SEE WHY WE SHOULD PAY FOR THOSE THAT DO - I WANT TO SPEAK TO YOUR SUPERVISOR"!

    Does that mean a no no then???

    The N1 forms for court don't look too bad but if they throw in the statute barred thingy then it may be a waste of time. I would ask tiggrae about whether you can claim for the times when it was not statute barred????

    I agree is to try to contact them, see what they say, you may require a letter from the liquidators, so if they have dissolved, you will need to try and find out who the liquidators are, such as "begbies & traynor" for example are the ones we had this confirmed from about the loan companies who have gone into liquidation where we tried to pursue from, these liquidators/administrators take over from the company, these should supply you with a letter.

    Saying that you could still contact the FSCS,(the compensation scheme) who maybe able to confirm this for you, then you can start by getting the ball rolling quicker.;)

    The post for you was at 4995 - this is it

    County court is your only way now - there is the risk of them trying to get it statute barred, if so you can request the court look at it your claim under Section 14a of the Statute of Limitations Act 1980 - this is for claims under tort for negligence (claims under tort are normally statute barred after 6 years) - basically this section allows for an additional 3 years to make your claim from when you became aware of the act which caused you damage. As you would be claiming for Negligent Misrepresentation (ie you have suffered negligence) this clause should apply. However,- there is no precedent set, but under case law you can ask the Judge to allow the 3 year extension soley on the individual facts of your case that you were not in a position to know you had been negligently mis representated to until recently (ie not working in law, finance etc etc) recent media attention

    you would only use the above if after you've started your claim in the County Court they put in an application to get it statute barred

    you can definately claim it back - START IT NOW !!! but be aware that Barclays will probably take it off your loan as you're in a CCJ situation - but hey that's better than nothing !!

    What i wanted to know is from the time that the FOS receives your complaint and then sends out the letter to say its awaiting adjudication how long before they can tell you if its something they can or cannot look into - or have they already checked if it is before sending out the letter to say its now awaiting an adjudicator????
  • Hi dont know if anyone can help me. My mum has a personal loan with Barclays which she took out (with the dreaded ppi) in 2005.
    I advised her to cancell it after looking at the t's and c's and realising it is costing £80 and it was a 10 year policy.
    She hasnt been missold so not an avenue we're able to go down.
    She's spoken to 3 different people at Barclays, the latest of which told her they "have to recalculate the loan as it was a single premium policy" and that if she cancelled the ppi she would have to accept the new loan at 19%!!. Considering that the current loan is on 7.4% I'd say thats pretty unfair and obstinate.
    Particulalry that my mum wants to cancel to save money and stated this during the phonecall.
    Does anyone have any advice at all? I'm sure this cant be acceptable.
    Not quite sure what to do next anyone know the best course of action?
