    I take it that you saw tiggraes response (post 4787) to it before. She has said the county courts as an option.

    Just had a letter from FOS about my co-op claim and that it is awaiting an adjudicator now. (yawn yawn...) I just hope its one way or another by Christmas time.:D

    County court is your only way now - there is the risk of them trying to get it statute barred, if so you can request the court look at it under Section 14 of the Statute of Limitations Act 1980 as you have suffered negligence - there is no precident set but under case law you can ask the Judge to remove the time limit as you suffered economic loss and were not in a position to know you had been negligently mis representated to

    Hi tiggrae, hope you are well?

    Just thought I would let you know MINT offered me the rest of my charges yesterday and are sending me a cheque for £77 in respect of credit card charges - I asked for £101 including interest and they have paid up £95.05 in total - I'm glad I persevered! :j

    Good Luck to all of you claiming back YOUR money - keep trying as I did - it only took 2 months and I got the lot back! (Well barr £6 odd - but who cares!! :rotfl: )

    Just got to get onto Barclaycard now..........!!

    There are anumber of things they should have told you under the FSA's Insurance Conduct of Business Rules that all brokers/lenders must comply with since Jan 05. Section 4.3.6 sets out things the broker should consider when advising or giving information to a customer and one of these is COST. As monthly premiums are invariably cheaper this should have been drawn to your attention. When FOS upholds a complaint it will cite against single premium PPI, "failure to provide a monthly alternative".

    Having received a successful claim response from HBOS (£5,052!) I have read and re-read the letter sent and have a slight concern...

    As the loan is still current, they've advised they'll need to arrange a new loan for the amount outstanding, minus the PPI.

    Do they have to honor the original rate, or will they slap on a higher one (scoring will be lower than 5 years ago).

    Anyone else had this issue?

    Thats a relief - I had visions of the interest doubling and being no better off!
    You've put my mind at rest. Will wait for the letter advising the new installment + rate which should arrive within 14 days.

    FSCS form posted, recorded delivery, even though it was pre-paid at first class it did not cost much to do this.

    Anyway, I'm going to add the tracking number in case I mis lay this.;)

    DV 1154 2619 4GB

    Fingers crossed it should reach the department by tomorrow.:D
