    I really need her to comment on what singlep says to us. I don't want to give people misleading advice on here and we have a complete difference of opinion with the two or we are taking things they say wrong.

    Tiggrae does say (i have looked back at her posts here) that complaints for unfair rebates are about the date of the settlement and they can go to FOS with that date in mind.(ie Di's complaint was about an incident that happened in 2005 but the sale was 2004 when they were not regulated)

    Singlep says that its still another insurance complaint and that its the date of sale that matters in complaints to FOS regardless as to whether the complaint was about misselling or unfair rebate .

    Sometime ago FOS dismissed my claim for unfair settlement as they were not FSA registered at the time of settlement but they were members of GISC at this time but not at the time of sale.

    I have just looked at the court claim form N1 and it does not look TOO scary;)

    Have just received the application for compensation from the FSCS, looks straight forward. will keep you posted. They have not yet declared Picture to be in default so it may take sometime,can't believe I am the first to make a complaint since they went into receivership!

    A SUCCESS STORY!!!

    Today we have received a letter from Halifax confirming they will refund the PPI paid to date as follows:

    Refund of premium paid to date: £2,673.63
    Refund of interest at 8.9% paid to date: £1,379.69
    Interest at 8%: £810.66
    Refund of last 3 months interest: £188.89
    Total: £5,052.87

    The paragraph above the breakdown mentions a refund of the last 3 months interest accrued on loan xxx to off-set the fortcoming 2 month deferred period on your new loan, plus interest at 8%.

    Can someone advise what that part means? I read it as the next two months will be loan re-payment free but am probably completely wrong!

    Thats great news, so does that mean they are sending you this as a cheque or are they using this towards your loan? so will you actuall physically see any of the refund? im soon to be in teh same posistion, as the adjudicator have worte to Halifax upholding my claim, so just waiting to see what they offer! x

    Getting there with the form, filled in all the nitty gritty bits but will write drafts in rough before adding it in the form to make sure nothing is missed.

    Have lots of paperwork to dig out thoughphoto-copying for and think that will take the longest.:rolleyes:

    Will not post this until Monday now though by 1st class recorded delivery.;)

    With a bit of luck the form should reach them by the Tuesday.:D
    Then its then a waiting game which can even take up to six months, quite similar to the FOS really, can take longer, yet when you think of the waiting with the FOS now as they are overloaded with these complaints.......there is not much difference at all I don't think.;)
