Yes - does that make a difference??
Well if its a premium paid monthly then you cannot make a claim for an unfair rebate.

I am happy to be corrected and if I am wrong there will be a clear reference to the validity of a pre05 PPI-non GISC subsequent rebate claim in the FSA Dispute Resolution Handbook or associated guidance. I cannot find it and I have spoken to FOS who do not know about this either. Help, where is this authority?
Singlep we have taken this information from Tiggrae and she has answered this again today. We will have to wait until she is back on later perhaps and ask about her experience. Its just too confusing here.

    She has taken said this

Therefore, in conclusion all I can say is that if your claim falls within the 3 categories (ie not paid out, mis sold or unfair rebate) then initial contact whoever is responsible - if your claim is not upheld by them then contact the FOS to see if they are allowed to look at your complaint (ie did the company concerned come under their jurisdiction at the time the event took place) as they appear to be the only ones with the definative set of (unpublished) rules about what timescales exist.

I would have thought if its about unfair rebate then its the time the unfair rebate took place.

Isn't this maddening Di. I would pursue as HFC trading as endeavour perhaps???

Where is Tiggrae to explain this to us. I wish she would about what singlep says about the dates etc and it not being about the settlement date of the policy, its still about the sale date.

Yes I agree its very maddening hun...... .

I think it may be worth trying this through the HFC then, in fact I did receive an email a while back from the FOS when they confirmed they could not proceed with the Endeavour (about the mis selling part) as they were not then registered in 2004 when taking out this policy and they did send me the addy details to HFC and said to try to pursue through these, also HSBC, but I wanted to clear these avenues first, and.............a thought has come back to me on this too......well.....because it was then about the mis selling and Click dissolved (oh I hate that word and fed up of saying it)......  , as the paperwork from Click was labelled with HFC, then I could go back to the mis selling again being as they were registered in 2001..... , what do you think ?
Or should we wait and see what Tiggrae has to say first ?:D

    Thx hun

If anyone from FOS ever reads our posts on here could you perhaps put an online register of previous GISC members so we can find out prior to complaining and also put some firm rules and dates especially for us to follow.

It would make life so much easier.

Perhaps a little complaint thing online whereby we put the nature of our complaint in and state the company and then see if we are elegible to take our complaints to you in the first place.

  • Thanks di3004 It was my first letter and to be honest the reply by black horse seems very standard as it does not actually go into any points raised in my letter at the very start they point out about not being registered till 2005.

Going to send a reply putting bullet points in this time asking them to respond to each point and enclose copies of the original paperwork sent to the wrong house number. I also pointed out to them that PPI was only for my OH not me but that i would infact be liable for the debt as much as him and they never aknowledged this. Will update on how I get on.

Its worth another shot hun, but I am wondering if these were members of GISC ? , if that's the case then you will still be able to take it further to the FOS.

Maybe one of the other members here could confirm this.;)

Good luck and we look forward to to hearing the outcome of this.:D

I have been reading the thread all day and as I am going for unfair rebate on a policy sold in 2003 and paid up in 2006 I was interested to see what would be my options if I got nowhere with the company. Having got a bit confused  I followed a link to the FSO where I had the option to email my query about my dates and if they could help if it should come to this, I had an email to say I would get a detailed response next week so I will let you know what they say. I was interested to see that they would get in touch with a company for you if you couldn't trace them or if you didn't want to do it yourself.
