But as this is not about the selling or mis selling and just that of the "unfair rebate" settled in 2005, I'm still uncertain really......The one and only "Dizzy Di"0 -

Just popping on to say hi to you guys....had a little read.
wowwwwwwwww its blown my head off!!! So many of us having the same/simular fights.....wish I could knock a bit of sense into these punks!!
Ok well i'm off to have some light hearted fun on some of the other forums
for a bit...O.H's got the week off so gota do some organising to amuse him and our 3 year old.

Hi hope someone may be able to help. I had a loan with black horse under chartered trust back in 2001. I am trying to claim back PPI as when the loan was first processed i was told by black horse that there was no credit history for me at my address and they would only offer a loan if we took PPI. So I agreed. On receiving the paperwork i noted it was for a different house number from mine i called black horse to let them know and although this was in 2001 i remember asking if i still needed PPI i was told that in order not to have the ppi i would need a new loan application and it was sugested that there was no gurantee i would be accepted for a new loan so being stupid and not knowing any better i agreed for the information to be amended to show my correct house number. Got a letter back from BLack Horse today saying that we signed the agreement showing we had read and understood the PPI and that they will not be refunding any premiums and at no point do they answer my question about the mistake made by them being the reason i beleive my ppi was misold. I have the original letter and standard security all made out to the wrong address as well as a copy of the CCA document that you can cleary see has had the house number changed that we did sign.
Sorry for the long post but not sure where to go from here. Any help would be much appreciated.0 -
Unfair Rebate is just another reason for complaint to FOS, as well as misselling BUT it is only the date the ppi was sold that counts for any FOS complaint. There are no complaint types that are exempt from the date rules. I am afraid you are pursuing the wrong route here.

Regarding my question above about not going the correct route here as it was HFC/HSBC linked as on paperwork and these were registered prior to Jan 05, should I pursue through one of them companies instead ? as it seems to me going by the letter received just recently that it is them that have been investigating this complaint ?The one and only "Dizzy Di"0

I would give it another go and complain about this, thing is I do find that companies that were not registered by the FSA prior to 2005 seem to be the ones that always send these replies and like in a few of my cases its the same for me, because they know we are unable to take this further to the FOS.....:mad:
Was that your first letter and final response ?
If Black Horse were registered prior to 2005 and they send you a fob off letter again and their final decision then complain to the Financial ombudsman service.;)
Don't let this one slip by, what you received in your letter is a standard fob off, we may all have signed for PPI but then maybe we were not told to otherwise and thought it was all part of being accepted for a loan.;)
If you need further info/help hun, just yell, Tiggrae and Marshallka are here often too, who maybe able to advise you from here if your still unsure.

Where is Tiggrae to explain this to us. I wish she would about what singlep says about the dates etc and it not being about the settlement date of the policy, its still about the sale date.0
