    if you've got a final response then go straight to the FOS, waiting for a SAR is just a waste of time it isn't going to make them change their mind regardless of what is says on the paperwork you get back - it could say on it 'WE'VE MIS SOLD TO THIS PERSON HA HA HA' and they still wouldn't pay you back - let the FOS deal with it

    man, i thought i was pretty clued up...whats a SAR? The credit agreement is definately with GE Money and that is who I am paying the PPI too. They are just saying because the garage were the ones to sold it to me, it is them who will have to answer to whether or not it was mis-sold. Surely that is a discussion between them and the dealership and not me as no money was paid to the dealership and all paperwork is directly for GE Money?
    it's ALWAYS the person who 'sold' you the PPI you go after for MIS SELLING - not the company the loan is with

    In December 2008 my six years are up for making this claim. If FOS take longer than this then what happens there??? Can they then say its over the six years???

    Just ranting and off topic but been on hold now to PC World for over 30mins to an 0845 number. There is none for this number on saynoto0870. Tried them all and they are all stores. These numbers really p**s me off.

    Sorry I have not posted yet, but I am not a happy chappy and feel very unlucky again twice round......:mad: :mad: .

    As you know I have been fighting the Click financial group about a mis sold ppi that was confirmed dissolved in 2006, now this morning I had a letter with a return of my cheque payment from the liquidators for e-loan brokers as they had unfortunately went into voluntary liquidation in May 2008, just over 2 months ago........:mad: :mad: , how sick is that for twice over ???

    Anyway, with the enclosed cheque they returned to me the liquidators enclosed a Creditors form to claim, but not sure if that would include me as such, any thoughts folks please, I do not feel good at the moment........:mad: :confused: , I feel cursed.....:rolleyes: .

    I know there is always the FLA, eloan/two-part were regulated by the FSA when I had taken this policy in November 2005.

    Thing is I was only requesting a SAR, not sent the complaint letter yet, so why the liquidators added this form I do not know, so I imagine this would be for the big people to make and a claim and not for the likes of me ?:confused:

    As you can imagine how numb I'm feeling right now......:o .

    Just had a reply from Tescos, they sent me a questionaire about my loan so that they could investigate my claim fully. Which, as my loan is with them, they should therefore have all the information they need. Shouldn't they???

    Not sure if some of the question on there are designed to catch me out as it asks for 'my recollection' on various things and 'what details' I have.

    I do not have to fill the quetionaire out and I feel that they should have all the relevent information and the reasons I feel I have been mis-sold the PPI from my letter (curticy of the template provided by MSE).

    I have also been allocated a case officer should I need to discuss matters with them.

    They are being nice and polite at the moment. Just have to see what action they take.

    no you've made a complaint within the 6 years so the 6 year limitations does not now apply - it's only if you left it over 6 years before making the first complaint - but if you were taking it to court you would have to start proceedings before December 2008

    Di don't despair because your loan was taken out after 15/01/2005 you can take your complaint to the Financial Services Compensation Scheme - that's a government organisation set up to deal with complaints against financial companies that have gone into receivership www.fscs.org.uk

    Thank you Tiggrae.;)

    So this form the liquidators sent would be for business people and not loan customers, and I right ?
    So from here would I need to still contact the liquidators or go straight to the FSCS, as I imagine they would need this letter to prove it ?
