    I will pop it in the post tomorrow as I say it will most probably be a FOS case so not building my hopes up on it being straight forward.

    I do not feel your letter has offered a satisfactory justification that my policy was sold fairly, reasonably and within my best interests so I request that you look into my complaint again. If I do not receive a more favorable response within 14 days I shall be taking my complaint to the Financial Ombudsman.

    So did the post man use your account before you did??? Wasn't it cancelled and a new account drawn up then????

    I am going through the paperwork again as I am coming across all these different breakdowns so now confused of the true amount that was rebated......:confused: , I have now come across an amount of less than £2K, and now think this is what confused the ombudsman when they were actually dealing with the loan advance complaint, even though this is to do with the first loan......:confused: .

    So I have paperwork everywhere right now, trying to figure it all out, hopefully I will resolve this.....:o , lol.;)

    I thought the ombudsman did the calculation for you?? Did you have to give him a calculation??

    Because the FOS was dealing with the loan advance claim and not that of the first loan, he still thought we were penalised by the first loan, so he did leave a comment that we could try to redress this on the broker, and then he was just left to deal with the mis selling part of the lender nemo which we did finally win at the end of last year.;)
    Nemo while this was in with the FOS had supplied them with some information which also shown some documents going from one loan to another (advance) this had confused them at first, but then he had informed Nemo that these are 2 different loans, wheras 2 separate policies must be treated separately, as Nemo were at first trying to pass the buck on the broker, and the FOS informed them again it was separate and if Mr & Mrs XXXX would like to pursue the first one they would have to with the broker but the advance was all down to Nemo.;)

    (sorry a bit of a tongue twister there) lol.....:o

    Does that make any sense ? lol.....:D

    Here I have paperwork about the first PPI, this was arranged with E-loan but on the Nemo paperwork:

    This does not include the loan but just about the PPP Single Policy: I have wrote this as it looks.

    Nemo Premium (PPI): £8492.50
    Date of inceptions: 21/11/2005 (when the first loan was taken)
    Date of cancellation: 07/07/2006 (this was when we also had a loan advance).
    Age in months: 9

    Cashback premium: £1,679.15
    Cashback Commission: £43.00
    Cashback IPT: £86.00

    LASU Premium: £1,650.34
    LASU Commission £4,951.45
    LASU IPT £82.56

    Cancelled after 30 days £1,258.26 - 15% this should be below 19%

    Further advance with claims/arrears £6,271.65 - 74% this should be below 78%

    Further Advance: £7,633.28 - 90% this should be below 99% and above 59%.

    Factor:75.30%

    Here was the further advance Single PPI:

    £10,862.50
    Date of inception: 07/07/2006
    Date of cancellation: 24/09/2006
    Age in months: 3

    Cashback premium: £2,147.75
    Cashback commission: £55.00

    LASU Premium: £2.110.90
    LASU commission: £6,333.25
    LASU IPT £105.60

    Cancelled after 30 days: £1,998.32 (this was all they rebated off this) 18% this should be below 19%.

    Further advance with Claims/arrears: £8,410.80: 77% this should be below 78%.

    Further advance: £10,577.04

    Factor 93.50%.

    I had remortgaged at end Aug/Beg Sept 2007, and paid these off, we had won the case we complained about on the loan advance with the FOS, had not pursued at all with the broker on the first one until now.
    But when we had cancelled the PPI on the loan advance as shown after 3 mnths above, they only deducted the amount of that shown of £1,998.

    So looking a the positioning of the first one above that one only states a rebate of £1,258.26.

    I cannot make head out of tails with it really, its all mumbo jumbo, will have to work at it, does this make any sense to any of you folks ?

    All the above is just about the ppi and not including the loan amounts.;)

    If you can prove you are strugging this also comes into it, financially, with me when going through mine, I did actually send copies of my bank statement to prove my financial hardship, so it all comes into it.;)

    You should also be given a chance by the FOS to forward any extra information, but in the meantime, you can contact them to explain your struggling, perhaps making ends meet.

    With mine though it was towards the end of the complaint I had realised this, so was a little late really but what they did suggest was extra compo on top to compensate for all the stress this caused throughout the time, from the other party.;)

    Give them a ring tomorrow and enquire about the hardship etc, it maybe worth your while.

    Oh thank you so much Di you are so helpful, i can prove all that and send in a few statements, so i will do just that tomorrow, with a covering letter. Ill let you know how i get on.x
