As promised on my last post above I said I would copy and paste my email I received from FISA which I only received today after emailing them last week when I first received the response from the FOS regarding them unabling to process with this due to them not being unregulated at the time, so due to this I emailed FISA as advised by FLA just to see how this can be sorted out, (I have not mentioned to FISA though about me now going to pursue this through both HFC and HSBC as they were regulated and linked with Endeavour) lol, but anyway here FISA'a response !!

    Hello D

I thought my colleague XXXX XXXXXX had responded to you. If not I am sorry for the delay.

As the FOS point out the loan was sold prior to FSA regulation so there is no automatic right for compensation if the PPI was miss sold.

However, the fact there was an existing medical condition or no proportional rebate does not necessarily mean the insurance was miss sold. These are exclusions that would have been explained in the policy summary.

You may like to speak to the Citizens Advice Bureau initially because this is free or take legal advice at your own expense. However, I cannot assist any further.

    Kind regards,

FISA Head of Compliance and Regulation

    .........................................................................................................................

Helpful then (NOT). They are now using the thing about "I suppose by todays standards of sales it could of been sold better". FISA couldn't do anything anyway really. Its just the fact that they all stick together when it matters. Chin up and fight on. You are not going to be given it on a plate by the look of it but tiggrae is helping i see so at least you are getting good advice.

This is great, thank you, so should I forget writing to complain to the above firms ? And just get straight back to the FOS by writing a letter or filling in another complaint form ?
I will take a browse on your 3076 post too.;)

In fact I received an email today from FISA after requesting some information last week, they don't seem to be that helpful and looks as if they are trying to fob me off, and hoping I will not take this further.

Will post it up when I have five and cheers again for your helpful information and advice.;)

no get final responses from the companies - the FOS won't look at anything unless you've proved to have made a complaint to them - write telling them under section 75 of the CCA 1974 you hold them responsible for their aurhorised agents, include a copy of the document accessed on the 3076 post

Hi all. I'm not really savvy with the banking system , However, after reading the PPI related topics on this site i thought I'd download Martins template - format as necessary then send off.

    Today - I received a response from Lloyds *Pge1* *Pge2*

Is the pre-exsisting medial issue a Grey area ?

    Should i peruse any further?
    Do i have a case?
    What should i do next?

    Look forward to replies.

They have sent me contact details for the FOS etc so I'm going down that track. I can't believe they haven't paid up as, to be honest all their evidence is pure heresay.

Nice of GE to tell you that............knowing damn fine the FO can't do store cards.

I'm in the same situation if anyone has any ideas? FLA are a waste of time.

Was the being self employed the only reason why you claimed. Was it a front loaded policy also and what were the amounts of the ppi? How long have you had it for? If it was the only reason that you have made a claim then they have answered it with the letter. You needed to have made further complaints if you had any and if you have not then send another letter about it. The main claim is the front loaded policies that are only for 5 years on longer loans. There is talk of them being banned now.

That annoys me too when they do that but they have to offer you the choice. I feel it takes the michael a bit when they are typing these letters knowing you can't do jack about it. I bet they have a snigger.

Please can some help me. I stupidly signed up for a Dorothy Perkins store card back in 1995, won over by the sales assistant saying sign up today & receive 10% discount on your purchases. However I was never made aware of any PPI or ticked any boxes to request it. Over the years I have just paid the bare minimum payments via direct debit but they have been putting over £9 a month onto my account for the PPI, so in the last 13 years I have paid over 1.4k in PPI (for a £700.00 bill). I sent my first letter to GE Money at the end of May to try & reclaim my money, they came back with a letter to say that I had ticked the box on the application form (of which they enclosed a very bad copy of) I had been sent from them 3 copies of the policy term & conditions over the years, & they found that I had not been miss sold anything & basically that I was very stupid not to have cancelled it before now.
I then sent a second of Martins letters asking them to re look at it, again I got a reply back saying yet again they believed I was not misssold the PPI.

Help, where can I go now who do I complain to. any help would be greatfully received.

I was speaking to somoene who used to work there recently and she said it's common place for staff to be encouraged to pre-tick the box for PPI given that customers don't really get the chance to see any paperwork when they fill it in atthe till with a queue of people behind them
Almost debt-free, but certainly even with the Banks!

Yes, please do pursue further, these are more or less exactly the same letters both me and hubby received, what I would call fob off's. The staff should have been more responsible here.
I would send them a final request and give them just 14 days to reconsider their decision.

Right now due to these letters we have received the one of these, they are taking another look which reminds me I have to contact them to remind them as the deadline is almost up, but I also have one in with the FOS.

Someone will advise you of the best action to take from here and if you need help with wording I'm sure they will help with this too, just ask, but certainly don't give up, I am going to fight them all the way until I'm happy with the result.;)

    Good luck.
