    Hi there.;)

    I am myself going to try to pursue the Endeavour loan through their regulated linked groups, such as HFC and HSBC, because there was no luck with the FOS as expected, but wanted to exhaust this action first, because they were not regulated in July 2004, yet a 25 year loan paid off almost 24 years earlier in 2005. It was mis sold from the start and the rebate when settled.

    Also the brokers who arranged this have dissolved who were Click financial, unfortunately this happened in 2006......:confused: .

    Going by some threads I have read here I am aware Endeavour were linked to both HFC & HSBC Group, and the consumer consultant from the FOS said perhaps it may be worth me writing the complaints to both of these and take it from there because these WERE regulated in Dec 2001.

    The thing where I am stuck is writing the draft letter before posting it up, as it was defo mis sold, and I know even before this became regulated there are still some important points they should have used while selling these PPI products along with the loan.

    When receiving the SAR I note some of Endeavours paperwork at the bottom of the page they state part of HSBC, where on the brokers Click financial paperwork I have a sheet there with the headline HFC bank.

    How would I go about writing this and bringing these into it ?
    How would I put it ?

    Because I know when they will respond it will be the usual fob off letter, where they will deny any responsibility in this sale, and I am hoping to avoid them writing this.
    If anyone knows what I could add in this letter about my above questions and how to put it that will be a great help to me, I'm fed up of writing these drafts and ripping them up and binning them now..........:confused: .

    Regarding the mis selling bit I have a template for that one but because this is involving linked groups thats where I am stuck to add the rest....:o

    Will appreciate any help with this, thanks so much folks.;)

    hi please see my post at 3076 as the same applies to you. You need to make HSBC / HFC / Endeavour as Credit Grantors responsible for the actions of their agents Click.

    Make a complaint to the Ombudsman, telling them you want to envoke Section 75 of the CCA 1974 (see 3076) but make your complaint against HSBC Group plc Trading As Endeavour - as HSBC were under the jurisdication of the FOS at the time your loan was taken out

    This is great, thank you, so should I forget writing to complain to the above firms ? And just get straight back to the FOS by writing a letter or filling in another complaint form ?
    I will take a browse on your 3076 post too.;)

    In fact I received an email today from FISA after requesting some information last week, they don't seem to be that helpful and looks as if they are trying to fob me off, and hoping I will not take this further.:rolleyes:

    Will post it up when I have five and cheers again for your helpful information and advice.;)

    I haven't had the SAR back yet, but will be ready when it arrives. PPI was definitely mis-sold for the usual reasons (didn't cover the whole loan term, didn't cover both parties, ignored pre-existing conditions, PPI was made a condition of the loan, front loaded).

    We're also considering whether the loan is unenforceable.

    Current debt: approx £12K :T
    Getting there one day at a time ;)
  • I have received a letter from the FOS saying HBOS is paying as a 'gesture of good will.' Not happy with having to wait 4-5 weeks for the payment, but after waiting six months I'm sure i can wait a bit longer.

    Only 3 more cases to win against HBOS which are awaiting adjudication at the FOS and another 2 ( egg cc and northern rock loan) in the same position.

    Its along wait but happy with the first result.:j

    hi laini i have just recieved my sar back from loans.co.uk got cd an paper work a blank credit agreement and a copy of ppi plan not listened to cd yet when i have what do i do nxt thanks

    cant even open cd with password they sent me dont know what to do now please help

    Is it a computer type cd??? Ist it password locked?? I would get back to their compliance department and tell them that you cannot open it.

    As promised on my last post above I said I would copy and paste my email I received from FISA which I only received today after emailing them last week when I first received the response from the FOS regarding them unabling to process with this due to them not being unregulated at the time, so due to this I emailed FISA as advised by FLA just to see how this can be sorted out, (I have not mentioned to FISA though about me now going to pursue this through both HFC and HSBC as they were regulated and linked with Endeavour) lol, but anyway here FISA'a response !!

    I thought my colleague XXXX XXXXXX had responded to you. If not I am sorry for the delay.

    As the FOS point out the loan was sold prior to FSA regulation so there is no automatic right for compensation if the PPI was miss sold.

    However, the fact there was an existing medical condition or no proportional rebate does not necessarily mean the insurance was miss sold. These are exclusions that would have been explained in the policy summary.

    You may like to speak to the Citizens Advice Bureau initially because this is free or take legal advice at your own expense. However, I cannot assist any further.
