Just had a follow up letter from the FOS and they have said that the complaint against Firstplus re settlement etc is not within their jurisdiction after first telling me it was. I feel so annoyed about this as i was told at the time I asked about this that it was. They say they cannot do anything about it as Firstplus Financial Group PLC did not come in until January, 2005. Even the thing about the wages being a different address than we gave them does not come in apprarently. I was warned by the FOS that FIRSTPLUS could argue that this nothing to do with them. I bet that is what they have done.

They have also stated they cannot do anything about the PPI also as that is outside their jurisdiction and also they have no idea who actually sold this to me. Firstplus, Freedom and Bespoke are not within their jurisdiction and Karacus Limited is not even on their data base at all.

I feel like all these helpful aids for the consumers are taking the pi** here and nothing matters what anyone does to you. Just have to pursue the court case with Freedom but beginning to think thats a waste of time.(thats just because of today though). Perhaps judges think that its ok to mislead and con people and fake wage address's etc. I really feel let down by this bl**dy country. It stinks and i may well head for Gibraltar to join the other side or the law.

Bespoke is the one i go for i think as everyone else say "nothing to do with me". Freedom said yesterday that they could not see that THEY had done anything wrong. I think all three have, mislead, lied and consipred. I will certainly consider the media now to find out about this Bespoke and what sort of fiddles they ARE up to.

RANT OVER (well nearly) and how i feel now "p*ss to the law". Everyone else does. You want to bring up your kids to respect the law but all i see is money and power gives you laws of your own.

Please can someone tell me whether I may be able to claim. I took out a loan with Lombard Direct about 3 years ago, I did not ask for PPI at the point of application as I never have PPI, and I think it has been added onto my payments when I applied for my loan. I have requested a copy of my paperwork because I no longer have it, as the account is now closed. What I want to know is if it turns out that I have paid for it, am I entitled to claim it back on the grounds of them not telling me about it, and just quoting me the monthly figure with ppi at point of application, even if I have signed the agreement? And what is peoples experiences with lombard direct on this issue.

    Cheers

yes you are entitled to reclaim. Lombard like all the rest are reluctant to pay out, but if it was 3 years ago you should be OK as they came under the jurisdiction of the Financial Ombudsman then and you can take your complaint there

    Marshallka + tiggrae,

Thought i would give you an update about Barclays Bank.

They are only giving me back £622.74 for the first Loan,

2nd loan they credited £999.82 the remainder from the first loan (hope all this makes sense guys. this was to lower the 2nd loan apparently, that is what she told me....

They have restructured the loan, the existing ppi 3808.20 and been credited the the new loan of £8,400.00 term 60months..

Tiggrae i mentioned about your figures she didn't say anything..

Not too sure if they are playing ball or just been favourable to the banks...

Any ideas, shall i still take it up with F.O.

    thanks for all your help.
If they haven't satifactorily worked out the figures and / or you want the money repaid to you rather than off your loan, get back in touch with your adjudicator at the FOS - email should be fine - and get them to put pressure on Barclays

    Was going to use template:

I purchased the above policy from you in
but now believe that I was mis-sold this policy.

This is due to the fact I was not given the correct information when the policy was sold to me, as having looked at the paperwork for my loan I now realise that I have been paying for insurance that I did not know I had taken out so could not have been explained to me.

Unless you can satisfactorily justify to me that the policy was fair and reasonable I am requesting a full refund of all premiums, and subsequent interest on the payments, that I have paid to date. As I believe I have been deprived of this money I also expect 8% statutory interest, the amount a court would award, to be added to each payment made.

I look forward to a full and prompt response to this letter and for the matter to be concluded within eight weeks or I shall be contacting the Financial Ombudsman to investigate my complaint.

Is there anything else I need to add or take out??

sounds ok to me and as they have already been fined for misselling then that says to me that your claim has a good chance of being honoured. Tiggrae is the expert though.
that's fine, they won't pay up though, they never do without a fight !!!

I must of asked this question on this site lots of times about the Barclays thing but at the time i had my loan the woolwich plc owned them. I may just wait for Freedom to get back now and then go down this route. Its still outside the jurisdiction of the FOS is it not as it was the woolwich and to tell you the truth i think the FOS are not really helpful..???
