hi im sorry to hear you didnt win its si unfair,im thinking of not bothering with my court hearing now you cant beat these big companies:confused:

Dont give up without a fight. Mine was probably an isolated case as dont know of any others that have gone to court. If it does get that far, there is plenty of support on here and I will help you any way I can.

I took the loan/ppi oct 2002 the amount 4,325.77 was arranged with ppi,the ppi was £26.70 the loan was £113.17 but it was frontloaded and and they recon the ppi was a seperate loan added so my payments were £139.87 for 48 months, I finished paying it oct 2006,i complained in february this year after finding out about this website, they refused so i took them to court,i am complaining i was pushed into the ppi by a pushy member of staff who made me feel i had to have it also im complaining about the interest i pain on the ppi which is £455.83 which i never realised was a second loan,i won by judgement on 20th may and they are applying to put it aside due to a solicitors error!
oh OK, so they're not trying to have it set aside due to the length of time - stay with it then, to be honest I'm surpirsed they've not attempted to settle out of court given the relatively small amount - they can't have it time barred - SO DON'T GIVE UP !!!!!!!

    Hi Slogger

That certainly sounds excessive. To put into some persepective I had a loan:

    £15000 over 5 years at 14.9% APR.
Repayments were £436 per month which included £91 for PPI.

It definately sounds as if something is wrong so if you are in a position to help them, then that is really lovely of you.

Will do anything to help anyone bite back against LLoyds TSB.

    Sally x
Hi slogger the more I think about your neighbours case the more annoyed I get, I've just successfully reclaimed for a guy who is blind and obvioulsy can't read or write - I haven't charged for my services and if you didn't want to do the work yourself I'd be more then happy to take it on - again no cost !!

    Hi,
I am a great fun and user of this site and already have been helped a lot and I will be always very appreciative of it, so thank you a lot but I need some more guidance as I don’t know what to do…
I have just successfully claimed from Barclays on the loan I have paid off earlier, I have another 3 claims outstanding with FO at the moment.
I have a little problem with my last claim, I don’t really know which way to go, and I would appreciate your help…
My partner took a loan with PPI while self-employed and for that main reason we believe it was mis-sold as well as we know now that we have not been given the right info then, so we have written to the bank in December 2007 but they have only responded to it with one letter, in the beginning of January saying that they were looking in to it, over the next few weeks we have made couple of phone calls but silly enough never written them any letters as to why the they were not updating us on the process. Weeks and months have passed, life went on …so we have contacted FO and they said that we can still put a complaint with them, so we have done that and last Friday they were asking us for the final response from the company, of course we do not have it but the FO says that we need to be fair by giving them enough time to response. Does it mean we have to write to the company all over again, giving them another 8 weeks etc? How long do we need to wait for the final response, we been already waiting almost 6 months, isn’t that enough?????? !!!
I hope I made some sense in all of it, forgive me if it is a bit chaotic…Please help.
    Thank you

You should give them 8 weeks but you say you have given them longer. Do you have proof of this? This is why letters and recorded delivery is better in situations like this. Also i note the self employed thing is a main reason why you are claiming missold. Some policies actually do pay out for self employed if you are paying class 2 and class 4 NI i think so do check this in your terms before submitting your claim to the FOS.

I would send an amended claim into the FOS, firstly your complaint is that you made a claim in December 07 (attach a copy and correspondence received) and some 7 months later they have failed to provide a response to which is against the statutory time limit set for a final response to complaints and secondly your actual complaint - I'd also send a copy to your bank as 'a courtesy' again reiterating that you have given them 7 months in which to investigate

but as marshallka states, if you were paying Category 2 NI you could be covered by the PPI policy - if you are NI exempt or not paying NI then you almost definately weren't
