Hi They will be awkward and they will fight you every step of the way. Have my OH PPI on CC with Barclaycard in with FOS at the moment awaiting result.

Do not give up they rely on people not having the courage or information to take it any further. Read through this site and also the success board. Make sure you know exactly what it is you are reclaiming and the reasons behind it.

Use the letters on Martins web site and just be patient and persistent.

    Hello

Many thanks for your reply - I have since downloaded a complaint form off the FOS website which I have filled out and is ready to be posted. I will do it on my way home from work tonight! I will just sit and wait to hear from the FOS now! Thanks for your words of enncouragement.

Another query you may able to help me with - Barclaycard wrote to me a few months ago saying they have lowered my credit limit and ever since I have been inundated with over limit fees due to interest rates and PPI - do you know if there is anything I can do to up my limit back to what it was? If it had stayed the same there would be no problem with going over my limit as I pay off the minimum each month sometimes more if I can afford to. Thanks again!
Barclaycard PPI £274.84: Currently with FOS
Barclaycard Fees £226.87: Still being hit with overlimit fees due to BC lowering limit
    MINT £101.61: Accepted offer for £95.05! 17/08/08 :T
Abbey: Waiting for list of charges

write and ask them to raise your credit limit as it's basically their licence to print money as they can charge you over the limit charges - you can claim these back - but you'll need to go onto the bank charges forum for how to do that

I think you may have confused them as you've put in 'about the ppi element' how you should have worded it is - are you looking at both the repayment on early settlement of the PPI policy in 2003 and the original Mis selling which took place in January 2000 or just the early settlement element ?

talking about the ppi on the loan will mean nothing to them as you're not differentiating between the two separate elements of your complaint

    Hi tiggrae,

Sent another (god they will be getting fed up of me)

    Is this one better

I am so sorry to have to email you again but what I should point out was that my complaint was about the settlement with Firstplus. I was told by the FOS when I called some time ago that the PPI misselling was not within their jurisdiction but when I have written to you with my complaint about rule 78 early settlement (and numerous other discrepancies upon receiving my SAR from Firstplus) I did ask if you could please look into the way in which this policy (the PPI element) was actually sold.

I have had no acknowledgement of this being the case yet but yesterday I did ring up to ask about this as I needed to know because if it was not then I would like to start proceedings in a court and time is running out on my particular claim. I was told by the person that took the call that "I should wait a while" and that the policy was still in place in 2003 but I don't want to wait a while and then after you have looked at my complaint for you to say "we can only look at the "settlement" and the PPI element is something that we cannot help with" as according to the person that has been helping me on a forum (she claims PPI for a living) my particular claim will become statute barred.

Once again sorry for the confusion but like I say I need to start proceedings in court if you cannot help yourselves.I know this policy was missold and I don't want to give up on trying to claim back what they have taken from us.

Thank you for taking the time to read this and if you could please let me know one way or another I would be most grateful.

    regards

On the positive side maybe they will look into this and squash the whole loan and get me compensated for the lot.

i went into the halifax today and i paid of my loan early, i looked at the computer screen and on my £2300 loan. i had paid £503.57 insurance.. i never knew i had this and i complained,, the halifax are trying to make it difficult for me to get a refund.i asked the advisor to send me a copy of the loan agreement and this is now in the post. first the halifax advisor said.. it says here that you took the loan out over the phone, so you'll have to phone this number 845 600 6007

i got home and i phoned halifax insurance,, i gave them my account number and they said..yes you had insurance,, i said" i always say no to insurance to keep the costs down. i believe i was mis-sold this policy" she said, "when the courior came round your house with the paper work, you would of had chance to read through the paper work.. and you signed for the loan and the insurance...

well i dont know if anyone has ever had a courior round there house, but this is how it went.. open the door,, courior asks for ID.. then open the letter, courior points at the line to sign and then the courior is on his way... thats how it went with me..

the woman at the halifax said i signed the paperwork.. what do i do?

I would put in writing that did not ask or want this policy and see what they say.

    Hi folks

    Just an update.

Contacted the FOS today regarding my complaint with Endeavour, and nope they were not regulated by anyone in July 2004, but the guy said still wait for a response first, but it may look as if the only action we can take would be the court route.

Anyway, as it was 'Click Finance Ltd' who were the brokers who arranged the loan with Endeavour, it has been confirmed that the brokers actually dissolved in 2006, so as I was given the liquidators details I contacted them (as I did send these a letter a few weeks ago too - to see if I could possibly pursue this through them), but the guy said they have just looked at the letter and there is nothing they can do, but recommended to again take it back to Endeavour who were still unjustly enriched by the sale of the product. This was just advice really.

So like I said its a bit tricky this complaint, and have even contacted the FSCS (financial compensation scheme), to see if they can do anything, but again its very unlikely because Endeavour were not regulated in July 2004, even though they obviously are now.

I suppose I could keep on with Endeavour as they are aware their 3rd party brokers have dissolved and still have a responsibility of this product, afterall most paperwork is headed with their logo's !

Or even write to the HFC perhaps.
As they were part of these.

Okay now I have taken this most angles so far and I know the FOS will not be able to deal with this, before thinking of the court stage do you think I should write to the HFC bank ?
Because with the courts Click are not about now to take them there :o  .

And what type of letter do you think I should write, as I would have to explain what I have done so far ?
Cheers folks and again sorry this is so long.:o

tiggrae, i emailed fos yesterday and put this as Laini suggested

Hi sorry to bother you again but after calling this morning i asked about the ppi element of the loan and whether or not you could look into this as well.
I really need to know as someone that does these claims for a living says that my ppi claim will become statute barred unless i get the ball rolling now. If you could be so kind as to let me know either way on this i would be very grateful. During my call to you the person i spoke to said to "wait".
If you are looking into the ppi then i have no need to get the courts involved but if you cannot then i need to start proceedings now. Please get back at your earliest and sorry once again for being so anxious.

and today have got this reply
Thank you for your email. If you have not raised the PPI element of your claim in your original form then you may have to set up a new complaint with our Customer Complaints Department. Their number is 0845 080 1800 and they will be able to discuss this in more detail with you
    .

I still do not know where i stand. What do you think on this one.

I think they know that i have not got a chance with either claim and maybe they are going to wrap it up quickly as they can. Is that my negative thinking do you think or the right way to look at it.
