    Hi

I sent my first letter to B/Card asking for a full refund of PPI payments since taking out their credit card in 2003 to which I had a Final Response letter yesterday saying that it was my responsibility to check at the time of signing. I can't remember anything about PPI at the time - it was 5yrs ago and I was young and naive. It's only since looking on this website I've realised I didn't need PPI and have since cancelled my payments in May this year.

I sent an e-mail to the FOS this morning asking for advice - just waiting on a reply now.

I just wondered if anyone has any information on reclaiming PPI from Barclaycard and if it's worth pursuing my case even though I took out PPI in 2003?

I would be grateful for any feedback.

    Many thanks :)
it's Barclays policy to deny ALL claims- make a complaint to the FOS, Barclays were within their jurisdiction in 2003, you can download the complaint form from their website - don't expect a quick response though as they are taking about 6 months to deal with complaints

Hi They will be awkward and they will fight you every step of the way. Have my OH PPI on CC with Barclaycard in with FOS at the moment awaiting result.

Do not give up they rely on people not having the courage or information to take it any further. Read through this site and also the success board. Make sure you know exactly what it is you are reclaiming and the reasons behind it.

Use the letters on Martins web site and just be patient and persistent.

How long did you give them. Some people say 8 weeks for a final response.

i gave them the 8 weeks but i thought they might have sent a letter to say that they recieved my letter

I always send these types of letters recorded delivery and then you know that they have received your letter. Can you not ring them and ask if they have dealt with this matter. They may say to you then "what matter" if you have not sent it recorded.

they should have acknowledged receipt of your complaint - either send it recorded or fill in the complaint form for the FOS saying you've given them the statutory 8 weeks to provide a final response and they have yet to do so - then send a copy to the provider as 'a courtesy' that will give them a boot up the backside to respond to your complaint !!!

you need to look into what the FSA has had to say on 'pre-ticked' on line applications - they've told all providers to stop doing it as it made it appear the PPI was compulsory.

tiggrae, i emailed fos yesterday and put this as Laini suggested

Hi sorry to bother you again but after calling this morning i asked about the ppi element of the loan and whether or not you could look into this as well.
I really need to know as someone that does these claims for a living says that my ppi claim will become statute barred unless i get the ball rolling now. If you could be so kind as to let me know either way on this i would be very grateful. During my call to you the person i spoke to said to "wait".
If you are looking into the ppi then i have no need to get the courts involved but if you cannot then i need to start proceedings now. Please get back at your earliest and sorry once again for being so anxious.

and today have got this reply
Thank you for your email. If you have not raised the PPI element of your claim in your original form then you may have to set up a new complaint with our Customer Complaints Department. Their number is 0845 080 1800 and they will be able to discuss this in more detail with you
    .

I still do not know where i stand. What do you think on this one.

I think they know that i have not got a chance with either claim and maybe they are going to wrap it up quickly as they can. Is that my negative thinking do you think or the right way to look at it.

I think you may have confused them as you've put in 'about the ppi element' how you should have worded it is - are you looking at both the repayment on early settlement of the PPI policy in 2003 and the original Mis selling which took place in January 2000 or just the early settlement element ?

talking about the ppi on the loan will mean nothing to them as you're not differentiating between the two separate elements of your complaint
