many thanks to martin and to everyone in the forum for sharing you knowledge it has inspired me to go ahead with the claim, will post again when i know anything.

did he realise what a single premium policy was?
or is it because of unfair rebate ?
or both =mis sold +unfair rebate

I have used the template letter and sent to FirstPlus and they have said that the PPI was not with them but Norton finance. They have also sent the original signed application for which has the 'No' box ticked for PPI.
However, this contradicts loan agreement that we have (signed on the same date) includes payment for PPI - so it looks like there was no other option given which is part of my reason for claiming. My Dad is sure that via phonecalls he constantly said no to PPI.
FirsPlus have passed the complaint onto Norton Finance so I guess we'll just wait and see what they come back with.
Do you think it is PPI or unfair settlement that we should be claiming for? I guess we haven't lost anything claiming for the PPI and see what comes back. If it is not satisfactory (ie I beleive he has effectivly payed the PPI so a full rebate of circa £10k) then maybe the best bet is the ombusman and see what they make of it?
Thanks for any further advice you (or anyone else!) can offer.0 -
Can't find my original post. But if it jogs anyones memory it was a Debenhams card where GE Money kindly sent a copy of the CCA fro 1996 clearly showing that protection wasn't required.
As some of you kind souls predicted they have replied saying that it was requested over the phone. Utter rubbish but how the hell can we prove this. Please help as the wifes telling me she new I'd get nowhere but these people are just lying thieves who have really upset me.0 -

marshallka wrote: »Did you want the barclayloan protection? If not and it was a must of the loan then you should claim. What was the date you settled? You should be able to just write and then you will have to wait for their final response and then go to the FOS if you don't get anywhere. You may need to spend £10 on a SAR to get all the details they hold about you.
The last payment was Sept 07.
When applying online, PPI was added on automatically, but I suppose we could have then chosen a quote without

i feel that they have taken 2x ppi and stitched me up twice!!!! anyway how can they say 1 was missold but the other was not? i dont understand
make sure you get all the info on both loans
post up the figures so we can see what you have paid.
also they will send the phone calls on a disc but listen carefully to them, cos they can really twist your words and not give you clear info

Hi Laini - I'm not really sure what we should be claiming to be honest!

hi.i had a loan with first plus with a single payment ppi, then after a yr i got another , payed off the original loan (including the ppi) and set up another with the same t&c.(another single ppi) i have written to claime misssold single ppi. thay have agreed to the first one and asked us to sign an acceptance to cancel and payment(? how much) but refuse to agree to the second. they said that the tapes show that me and the OH agree to the terms.i have written back asking them to look into it again.
im not sure what to do from here? whether the accptance means the cancel of both ppi or just the first. i had a letter to say they have recieved my letter and will respond after the recheck. can anyone advse im a bit lost.0 -
