I have sent the standard letter to Beneficial as I reaslised recently that a card I have had since 1994 has PPI applied monthly on the balance.
The have written back quickly stating that as the card had this applied from the start and I have paid this since then I am therefore agreeing to the PPI charges and have made no effort to cancel this or query it. My payment signals agreement they state.
In conclusion they feel the PPI was added to the account in good fiath and point out that it is the customer's responsibility to review the statement and reconcile all transactions and so they decline the request for a refund of all PPI charged.
Where should I go from here - if anywhere?

Hi,
Don't know whether you have been reading my posts, but FF solicitors had until 9th June to submit documentation to the court and to me.
In the meantime however, the solicitor has phoned and emailed me to see if I will reach an out of court settlement.
Today, as we speak ie 12th June, FF solicitors have still not submitted any documentation. But they have come up with my request of £4575 which is what I asked for yesterday via email. Their original offer was £1000. They will do everything so as not to go to court, they know they will lose.
Hope this has been of some help Sally. You will win as they know they will lose. Stick at it.

Really pleased for you. I paid the £300 hearing fee today :shocked:. Yesterday was the cut off for the documents and I have not received a thing. Think they are probably going to rely on my documents and the Limitation Act. I can only keep my fingers crossed now they settle.

I have sent letter to Egg and First Direct reclaimimg PPI paid.With First Direct I am claiming that althought the PPI was in the O/H name only, the loan was in joint names - they have come back and said this doesnt make any difference. Egg was credit card over the internet they too have said no-saying I was made fully aware of the conditions etc... but I had a pre exisiitng medical condition that they said was up to me to disclose...just wanted to know has anybody esle pursued and won from these companies based on theses facts. Thanks.0

heres an update
I have the same ppi complaint with FOS about NEMO finance
the FOS are waiting for a reply from them as they are upholding our complaint.
it has taken 38days for our SAR from them.
they are really dragging their heels with the FOS too
they should have replied to them by 3rd june now they have to reply by 12th june.
our man at the FOS (same man who has upheld our FP complaint) is still waiting for them to reply but will tell us asap what will happen next
still waiting for figure from FP.
Darent start anymore complaints yet (got a couple more I want to have a go at).

Hi,
My Dad took out a loan with FirstPlus in Feb 06 and settled it early in October 06. The loan details are as follows:
Loan amount: £42000
PPP: £10285
Total amount: £52285
The PPI was added as a single payment at the start of the loan. The settlement figures that he got when he settled (8 months into loan) were:
Total amount payable underagreement: £90211
Less our rebate on settlement: £40886
Total amount payable by you: £49475
Roughly speaking they have charged him £7000 - does this sound like he has a case to claim? Should I be claiming for an unfair settlement or as he paid the PPI as a single payment is he entitled to claim the full amount back ie £10285?

Right here goes for anyone interest in the Bespoke Finance thing. (confusing).
Our first documents with a name on from anyone other than Firstplus is a fax from a company called lowcostloans.co.uk. This company was part of a company

Freedom finance was previously called Wilmslow Financial services ltd and this was from 1983 to 23/02/01 when they changed their name to Freedom Finance Limited and then again on 29/11/02 to Freedom Finance PLC which it is to date.
My first recorded document on FIrstplus's computer was that my application was received on 21st December, 1999 from a company "BRKWILM". This i take it is low cost loans in wilmslow cheshire. Although Low Cost loans ltd brings you to Freedom Finance old website not owned by Bespoke Finance on the address above it now is owned by Bespoke by the look of it like all Freedom Finances websites. I want to know when low cost loans changed as taking you to each of the above websites.0 -

You can make a complaint to the ICO if they do not send you what you have requested under data protection act, but dont expect a quick result.
It took over two months just to get an acknowlegement that they had received my complaint. When I spoke to someone on the phone they said they have a heavy workload. All the work backlog from ICO and FOS stinks of the banks purposely trying to get the system ground to a halt. :mad:PPI Reclaimed -
