    Hi,

My Dad took out a loan with FirstPlus in Feb 06 and settled it early in October 06. The loan details are as follows:

    Loan amount: £42000
    PPP: £10285
    Total amount: £52285

The PPI was added as a single payment at the start of the loan. The settlement figures that he got when he settled (8 months into loan) were:

    Total amount payable underagreement: £90211
Less our rebate on settlement: £40886
Total amount payable by you: £49475

Roughly speaking they have charged him £7000 - does this sound like he has a case to claim? Should I be claiming for an unfair settlement or as he paid the PPI as a single payment is he entitled to claim the full amount back ie £10285?

    Any help/advice much appreciated.

did he realise what a single premium policy was?
or is it because of unfair rebate ?
or both =mis sold +unfair rebate

I'm gonna sound really thick now but i was wondering if anyone could tell me if my mam is eligable to claim? i don't quite understand this ppi thing!

she paid 36 monthly installments of £27.73 for credit protection insurance scheme with carlyle finance whe she bought her car but she paid the loan off early.

Because she paid in monthly installments does this mean that she has nothing to claim?

I'd appreciate any advice and I hope i gave all you money savers a laugh for being so thick!

    Thanks again

    Donna

Just keep on at them. I have spent all afternoon and night finding information out on this company and it seems if you look at companies house they have loads of companies registered. Its so blummin maddening. I know i did not take a loan out with Bespoke Finance and i refuse to be told to deal with them. I will carry on my quest and eventually i will find all this mystery out and hopefully help others in the same situation as myself. Its driving me mad at the moment and i am suffering mentally as you can tell by my last post. I will get back tomorrow when i have had time to look through all i have found out. Keep fighting and don't give up. I won't.

I don't blame you, they are pushing it I am sure this kind of behavour from Halifax can't be in line with FOS. I will give them a week to remove my late payment from credit agency (Experian) and then I am going to contact FOS I have printed out page saying the Direct Debit is still active from Internet banking and proof that loan payment was in my account wiating for them to withdraw the money for loan. they are definely doing this because I dare to try to claim and they still have not replied to my claim at all. I am so disappionted in the Halifax. I did not think they would stoop so low.

Do not be surprised at anything their Collections dept do. The cheekiest person I have ever had the misfortune to deal with over the phone was in that Dept and like you he would not give his name to allow me to complain. He did, however, accuse me of being a liar the day before they credited just under £4000 to my account as a refund of my bank charges as Customer Relations had not left a note on the system to say they were refunding the money. When he called me a liar, I asked if the phone call was being recorded, he says 'Yes', so I told him he was the rudest little bas***d I'd ever spoken to on the phone and told them to 'record that and use it for soddin' training purposes'. Felt better after it. That was a good few years ago, but the rudeness still rankles.

They've lodged defence papers in my current PPI case against them and I await the details of these being passed to me by the Court. If it has to go to court, then fine as I've done quite a bit of reading from the FSA website which highlights that they have not followed some of the Regulations laid forth in that, so i will also be contacting the FSA to highlight those breaches and requesting they investigate my complaints.
Almost debt-free, but certainly even with the Banks!

    Hi,
Don't know whether you have been reading my posts, but FF solicitors had until 9th June to submit documentation to the court and to me.
In the meantime however, the solicitor has phoned and emailed me to see if I will reach an out of court settlement.
Today, as we speak ie 12th June, FF solicitors have still not submitted any documentation. But they have come up with my request of £4575 which is what I asked for yesterday via email. Their original offer was £1000. They will do everything so as not to go to court, they know they will lose.
Hope this has been of some help Sally. You will win as they know they will lose. Stick at it.
    Take care.

Congratulations! I would be delighted with a similar result but so far the Halifax's line in the sand appears to be immoveable. Every success story I hear gives me a bit of hope though!

you need to see the credit agreement does she still have it?

    does it say
    loan advance
    ppi
    total amount of credit

the settlement figure -what she paid as the amount to pay off the loan early

did she know she had been paying insurance for the payments
had she been told she had to take it to get the loan
post any information up and we will have a look at it

I have now been told by citizens advice, trading standards and a local solicitor that if the deposit you paid at point of sale (cash or car deposit) was shown as deducted off the insurance element of the agreement like mine and not the goods part theres a very very good chance a court would make this whole agreement unenforceable as this is not the right thing to do as per the CCA (the only blooming thing in place years ago). All the 3 people have said the same thing now and im told that its not guaranteed succession in court nothing is it depends on how you present it etc getting the right argument and getting it across correctly. I have been told theres about an 80/100 chance of success with this which is better than the other arguments estimated only 60% succession (missselling, insurance made compulsory etc). So guys get looking at the agreements and see where that deposit has been planted on the agreement. Thinking on this would apply to other companies too other than DAF look and see where that deposits been knocked off, this is the route im going down thats 3 experts saying same thing.
