    A quick question about SAR's (as I start my quest to reclaim this weekend). My girlfriend had a current account, credit card and loan all with LTSB. Would we be required to send three separate SAR requests letters with three cheques for £10 each, or can the request for details for the three separate entities be made together as one in one template letter?

    they have made a legally binding offer, however write back but put at the the top of the the page WITHOUT PREJUDICE, that at this point in time you don't accept their offer as the claim is before the ombudsman, however, you reserve the right to review your position at a later date. The without prejudice bit means you can go back and accept it at a later date

    Does this include loan value greater than £25,000, i.e secured on property?
    no unfortunately, I don't believe it does - simply because the Consumer Credit Act doesn't cover loans over £25k

    yes, as the 3 are treated by LTSB as being separate and individual accounts
  • Just received a letter from Welcome together with a cheque for £675.80 as a 'gesture of goodwill' against a PPI mis-selling claim I made back in April. Shocked! Needless to say the cheque's already banked! However, I originally had 3 mis-selling claims against them and this cheque only settles one of them. They're rejected the other two. Strange that they chose to settle one but not the other two when the (lack of) process was exactly the same each time and the details of the mis-selling absolutely identical. I'm extremely happy with the cheque, but am pressing ahead with trying to win the other two too. Many thanks to everyone on this site for their moral support and inspiration. x

    Thanks a lot Tiggrae, just to clarify, does that mean that if the FOS doesn't go in my favour, FP will still have to give me the £3,000?

    I have just had a PPI reclaim request rejected by Alliance & Leicester on the following basis:

    “Due to the Data Protection Act, we are required to retain customer data for no longer than 6 years from the date the account was settled. After 6 years records are destroyed, we are therefore unable to investigate the issues you have raised, as the data is no longer available.

    Current FSA regulations are that any complaint concerning suitability should be lodged with the company responsible within 6 years of the event, unless he has referred the complaint to the firm within that period.”

    The loan was started in August 2000 and was settled in August 2001. Although this is over 6 years ago, as I still have a copy of the loan agreement I signed at the time the loan was taken out, I tried to reclaim as per the guide on this website, namely that:

    “If your policy ended over six years ago and you have the paperwork: Reclaim, although your chances of success are reduced, as it will depend on what you can remember about the sale.”

    The loan in question was replaced by a further Alliance & Leicester loan, which they have already admitted to mis-selling and have paid out my reclaim. There is no real difference with regards to how the loans were sold – the paperwork for both looks the same and I wasn’t aware I had taken out the insurance with either loan until the subject of PPI mis-selling came to light in the media.

    I’m not sure what, if anything, I should do next?

    With regards to what I can remember about the sale, I can send them a copy of the paperwork which proves that the loan was sold with PPI, I can also prove to them the period the loan ran for. In addition, I can highlight the fact that the replacement loan was mis-sold. However, is this likely to change their mind?

    The closing paragraph of their rejection letter says that my complaint will remain open for 8 weeks, so does give me the option to try again.
  • Had a claim against The Oxford Caravan Centre rejected by the FOS 'cos they weren't members of the General Insurance Council when the policy was purchased. Also had a rejection from the FLA 'cos caravan centre wasn't a member there either. Any ideas where I go with this? Don't really want to ring caravan centre and ask who regulated them 'cos it'll indicate I'm struggling to bring a claim against them. Any other regulatory bodies I could try? Thx.

    Hi

    I am looking for some advice as to what to do next. I took out an M&S Chargecard in 1996, the application was made instore and the form filled out there. I requested a copy of the form and upon receipt it is clear that although I signed the form at the end the PPI section has not been filled out by myself but the member of staff - they spelt my name wrong!!! I complained to M&S and they just said sorry, but we aren't going to refund you and advised to go the the FSA. Surely though if the form wasn't completed by me it cannot stand, and I was not advised about the policy by the member of staff - something that they acknowledge, what shall I do???

    Any help much appreciated!
