    What are you wanting to do? Cancel it or request the amount back as missold? If it was missold then you need to write a letter asking for it back and interest as well.

    I got the SAR back a few weeks ago which included another copy of the agreement(showing PPI not required).
    On the letter they sent back they have said 'I can confirm your insurance was set up on the 19th October 2000 after a discussion that took place on the telephone with our Telemarketing Department'.

    They say she had 30 days to cancel as they sent her a policy summary and policy document. They didn't but how the heck do we prove that?

    I'm assuming someone else will have been down the same road as us but I really can't believe the front of these people.
    Shall I send them a note back saying 'Our abuse line rang you in 2001 telling you to shove your insurance where the sun doesn't shine'. 'We then sent you a document showing the place where the sun doesn't shine, but you didn't respond'.

    Joking aside I'm really upset by this as if the boot was on the other foot I'm sure they'd hammer me.

    Ask them to prove that you asked for it and had 30 days to cancel. If you can't remember and it was a condition of the loan they need to prove it with the phone call. They aren't going to GIVE it to you without a fight. FIGHT on

    Then if you did not it was missold and you need to send a letter asking for it back. Look at the link i posted and template letter. get one sent off

    If you put "welcome" into the "search this thread" box above you can see how people are progressing with claims. Its sometimes a hard battle but you will get there in the end.

    you're not being a pain. glad to help :D I am just the same and lots of kind people helped me in the beginning and now i am trying to give something back if i can. You will be guided through it step by step from here.

    They could only provide dribs and drans of information on the SAR with apologies for not having all the details. The chances of them digging up a supposed telephone conversation from 2000 will I would think be very unlikely. They gave me a telephone number to ring if I wanted to continue my claim. Should I ring the number or just write? Probably better to write as I'm still fuming.
    I appreciate that they will fight, but surely the fact that I have signed documentary evidence whereas they have simply heresay of a telephone call makes the fight worthwhile.

    Thanks again Marshallka I'll have to send you some money for a drink if we succeed s I've little doubt your advice would cost a packet if I went to a solicitor.

    I would welcome head office. Also state that you WERE missold. I would try to do your own letter from the template one as i noted on my SAR from Firstplus that they stated that my letter was a "template".

    Just googled welcome and whether they were regulated by the GISC at the time of your complaint and it looks as though they were not so the FOS may not be able to help. It may have to be the court route. I will do some more research later after lunch.
