PPI Reclaiming discussion Part II

its bedtime for me now as I am sure everyone has had heard enough of me.

OMG, What a week I have had.....I think my last post was on Sunday, I said that there were a few days left for Freedom to get their defence in and was asking mcolak what I could be doing in the meantime to prepare myself for court ( CPR18 suggested etc.)
The week started REALLY badly my dad was rushed into hospital he had a stroke and we have spent all week at the hospital.
As you know we were due to go away next week, so we put all plans on hold.
Then this morning the SAR came, well it is NOT what I was expecting at all!
A bundle of A4 sheets with less than a thrid of each sheet printed in jargon!
No telephone calls (surprise surprise)
Salesperson unknown (well luckily i still have a record of her name and the team she worked on!)
Basically its useless.
As I was reading through to see if I could make sense of anything, the phone rang and it was FF's solicitors, i was asked if I would be prepared to consider "coming to an agreement " to avoid going to court.
I said I would not consider anything less than what I am due (I think i have had such a bad week and I was still angry over everyting thats happened I was quite blunt which isnt normally like me:o )
Anyway i said my piece and he said he would "convey my thoughts to his client".
So....another afternoon of visiting at the hospital ( Dad is much better regaining use of arm and leg and is on the mend...thankfully)
When i came home ....message on answerphone..... solicitors....they have decided they would like to offer us the FULL CLAIM out of court, as a goodwill gesture, sceptically i asked if they would put it in writing and checked if the money was coming straight to us saying we would not consider it off the loan, they said yes, cash for us in 14 days or so.
But there is a rush to get it accepted as the defence would need to be in by Monday, and they would end up paying fees etc so he asked if he could email me the letter and for me and hubby to consider it tomorrow and send back an acceptance ASAP, to close the matter.
So....RESULT!:T :j :T :j :T :j :T :j :T :j :T :j
Just checking is this normal to ask via email for acceptance asap,
will they send the payment out as promised......not very trusting am I:rotfl:

ps sorry to hear about your dad....
some good news at last and well deserved.
I am still waiting for my SAR from them. i think its about just over a week ago then i start on them too. You will have to guide me through it.0 -

they have said they will offer me what is on the claim form.
ie...(I did these calculations and hope they are right and that I havent messed it up (cause they are VERY eager to settle)
PPI £2021.33
Interest paid to date (8th May 2008) £1832.49
8% stat interest £999.92
TOTAL claim £4853.74
Then there was the £108 court fees.
So Grand Total £4953.74....This is amount offered.
OK....so now does my monthly payment change? is the amount left owing still unfair.
i do not want to settle for the PPI and then find I'm still being ripped off, do they now need to restructure the loan (confused)
Ideally I would like to settle the loan and get a better deal elsewhere as the interest rate is high.
So ......what about future payments .....this is the part i dont understand .....if i settle then am I faced with this unfair rebate thing.
What advice can you give?

The claim is for £4953.74, but read above for the further details.....
They are writing via email tomorrow to offer this, but dont know how I then stand with the remaining loan, is there a way they restructure it to make it as if you handt taken out PPI in the first place ? I'm not sure how this part works.
But am pleased as punch with the offer and not having the hassle of going to court, I will say though, they are VERY keen to settle before Monday ...VERY! (which makes me wonder!)
I suppose everyones gone to bed now, but if anyone has any thoughts on that in the morning ,I will be pleased to hear from you.
I will not send the acceptance (they want me to Fax ASAP once e-mail received tomorrow) until you :money: my good friends tell me your views on the matter.0 -

Mine was for £18,000
with £2021.33 added for PPI (payable over 16 years)
So £20.021.33 in total.
(but tiggrae and mcolak worked out that over the full 16 years i would be repaying something like £47,000 or more !!!!!!:eek:0 -

Yes, thats just it, they are VERY EAGER for me to accept, I just need to make sure that everything is in order before I do, otherwise I may not be able to do anything more about it, cause we all know how crafty they can be. I want to be fully informed before I sign anything.

Will FO take the 6-9 months just to tell you that they cannot help eg the company didn't come under their jurisdiction etc at the time?0
