Are they actually looking into the prescribed terms etc...Have they told you this in writing... Prescribed terms on the agreement is a Consumer credit complaint and this was a thing that the FOS can only look into if the credit agreement was after April 2007..or if the firm was actually authorised by the FSA...

They hadn't told me that, no. My case was only agreed to fall under the FOS jurisdiction after I forwarded a letter to them from the OFT in which the OFT said that behaviour of the type I'd described would be unlawful and something that the FOS would investigate - nothing about timescales.

The second part of my complaint is about the miss-sale of the PPI cover on the card, and the final part that Sainsburys have refused to put the account on hold until a decision in the dispute is reached. There's been about £160 in interest alone added to this while I'm waiting for it to be resolved.
Almost debt-free, but certainly even with the Banks!

    Dear all,

Whilst in the process for reclaiming credit card charges for an Egg Credit Card I held from 2004 until 2006 (Egg loan to repay balance on the card) I noticed on my statements that I had been charged for PPI. I sent the intial letter to Egg requesting my PPI to be refunded. I have got the standard return letter from them, i.e. we sent you the terms and conditions within 14 days of you signing up for it etc etc. They have also supplied me a screen print of an account overview, this simply states that I have PPI, nowhere does it say that I requested it?!

Presently it would appear that it is a case of my word against Egg's, I'm unsure as to whether a SAR would hold the required information to prove that the box was pre-ticked or not!

I applied for the card online, however I cannot be 100% certain whether or not the box for selecting PPI was pre-ticked or whether I selected it myself.......

I don't remember taking out this policy, I was young (21) and financially naive......

Does any MSE user have any experience or success with regards to reclaiming PPI from Egg or any other provider with similar circumstances?

I HAVE had success in reclaiming £550 from PPI on an Egg loan that I had, this was taken out as a result of racking up £2400 on the credit card.......

    Please help!! Many thanks!

    Hi Tom and welcome.

If that was the first response you received, I would write back to them and ask them to reconsider this or you will have no option but to take your complaint to the FOS.

Tell them you are not satisfied with their response and would appreciate it if they could take a further look at your complaint as you believe you were mis sold (due to your reasons).

They should then send you a "final response" and if still not successful, you can get your complaint in with the FOS, as the FOS would like to see copies of all correspondence, also of your final letter you received in order for them to investigate.

I would get that letter off and if you've not a lot of information then I would request a SAR.

I have added a SAR template in one of the above posts, use that and they have 40 days to comply, but still get the 2nd letter off.;)

I have a complaint in with the FOS right now, which is a credit card ppi (lloyds), as they fobbed us off with letters like yours.

The letters they sent first of all are basic template fob off letters, the main of us receive them and they hope you do not take it any further.
So don't give up, keep at them and if they do not refund you in your favour post back and we will move on to the next step of the FOS.

Good luck and if you require further info please just yell.;)

Good luck Tom, your doing the right thing, its likely you were mis sold, it was a very common thing this, of PPI being automatically added to credit cards etc, so go for it, and please post anytime if you want more help here.:D ;) .

    Keep us posted, cheers.

I am just about to claim for the same thing and a SAR has not produced any evidence I requested it.
How did you win the loan PPI?

    Hi Pinknico

Didn't your SAR even have anything to show that PPI was taken ?

If this did not then they did not fully comply to your SAR request, because if this was added in with any credit, the company are obliged to add this information in with the documents.

Mind you this did happen to one of my mates where the ICO are now involved.;)

Just found an address on the insurance documents of Firstplus policy and it says in small print at the bottom of the policy and to claim the cashback for the 5 year thing too...

    Customer enquiries

We hope that this insurance will meet your requirements. Any enquiry or complaint that you may have should be addressed, in the first instance, to the claims manager of the scheme Administrators at the address above. Should you not be satisfied with their response, you may ask the complaints and advisory department at Lloyds to review your case. If you still remain dissatisfied you may contract the insurance ombudsman. The scheme administrators will provide thefull address of these organisations and the referral of your complaint to them and will not affect your rights in law...

Then it says how to claim

    Miller Firstline (NLA) limited
    PO Box 1910
    Waltham Cross

    Tel 0870 2414013

Now just googled this "Miller Firstline" and they are part of Miller Fisher Group and

How would anyone have been elegible to make this claim for their cashback from these....
