    Hi folks, I'm back......:D .

    Have been meaning to get on with these for a while (LLoyds) loans ppi, but getting the other stuff sorted out - out of the way etc.

    So going to get a reclaim letter done, I know I will get fobbed off like I did with the credit cards, but have to start somewhere.:D

    Will start with the 2004 one.
    Will have to yet go through the others, my sister has taken copies back with her, (copied them yesterday for her to take back with her), and go through them with a toothcomb as she says.

    It already has Di - it was the 6 weeks that the FOS said they had to get in touch with me direct about my 'refund'. They have agreed to pay up but then nothing.

    I PUT A POST ON BEFORE
    I GOT THE FACTS NOW AS IN MY LAST POST IT WAS ALL GUESSES.
    LOAN OF £2,300 OVER 10 YEARS, APR 29%. 1.44% MTH
    AFTER MAKING PAYMENTS OF £63 A MTH ON THE LOAN FOR 5 YEARS
    HAD A LETTER FROM FIRST PLUS FINANCE SAYING WE COULD BE ENTITLED TO 25% OF PPI BACK AS THERE WAS NO CLAIMS IN 5 YEARS.
    WROTE TO ASK ABOUT GETTING ALL PPI BACK AS WE THINK MISSOLD.
    RANG ABOUT TWO WEEKS LATER, THEY HADNT RECIEVED THE LETTER, AND SAID THAT £400 HAD BEEN PAID ON THE PPI IN TOTAL AND WOULD GET BE ENTITLED TO £100.
    GUESS WHAT THOUGH !!! ON THE CREDIT AGREEMENT IT STATES MIN PAYMENT £40 MTH, AND PPI NIL…..
    WE HAVE PAID ALL THIS MONEY AND STILL OWES THOUSANDS.
    I HAVE E MAILED THEM FOR A BREAK DOWN OF PAYMENTS FIRST JUST TO SEE WHAT THAT INVOLVES, THEN WE MAY GET THE ORIGINAL LETTER SENT RECORDED THIS TIME AND SEE.
    THING IS WHERE DO WE STAND IF THE PPI SUPPOSE TO BE NIL, AND THEY HAVE SOME HOW TOOK IT ACCORDING TO THE PHONE CALL??????
    ALSO ON THE BACK OF THE CREDIT AGREEMENT IT DO MENTION ENFORCABLE WHAT DOES THAT MEAN AS IV BEEN HEARING THIS WORD MENTIONED.:confused:

    Hi there
    I think the only way you will find out more about the PPI is to request a Subject Access request, know as a SAR.
    But the drawback is you have to pay £10 for this either by cheque or postal order payment.

    I will add a SAR template for you to use, they have 40 days to comply to this, and they must supply ALL the information they have on you, including phone call recordings, emails etc, and if PPI is involved this should also be on the information they provide for you.

    I see you have also requested for a written breakdown, when you receive that please add on here so that is can be worked out and calculated for you.

    Something not right about this and due to this I do think a SAR is then important, although if you do already have paperwork with the information on you should not have to request this, because this would be your evidence to back you up - to show that you did have this, it also can be used to back up your case in case you decide to take your complaint to the Financial ombudsman service.

    I would still do a reclaim complaint letter anyway, and tell them if they do not reconsider your complaint and uphold this, you will not hesitate but to forward if to the FOS.

    I will post up the SAR, so please look out for this, also the link to help you reclaim this back.

    Now regarding the other issue you wanted to know with the Credit agreement, I have never been down that road, but do know charges occur with that.

    Yes I did read on that afterwards, sorry I mis read this earlier.;)

    I was in the same position as you with one of mine, and it came to the stage that I sent a letter before action (LBA), I gave them 14 days before taking further action, normally they read this and they know they must pay out, so it will not actually go into further action.

    I had to confirm this to the ombudsman who was dealing with my complaint, and they requested a copy of the LBA for their records.

    I have been trying to find my LBA but where it disappeared to I do not know, but it is well worth doing this but make sure its okay with the FOS dealing with your case first.;)

  • If I had a loan that was paid off early,what info do I need to be looking at to see if I got a fair rebate?
    It was a few years ago but am now curious to see if I got 'ripped off' or not.

    -Full hard copy print outs of my personal or financial information, held in a digital, magnetic or any other format which is held in any archives, backups or other storage devices / locations.

    I enclose a cheque in the sum of £10 to cover your fee.

    If I had a loan that was paid off early,what info do I need to be looking at to see if I got a fair rebate?
    It was a few years ago but am now curious to see if I got 'ripped off' or not.

    May I ask how long ago this was hun that you had settled this ?

    If in the last 6 years, you could request a written breakdown free of charge, they should post this to you within days, you will know then how they broke this down.
    If they have not actually supplied you with an explanation within any of your paperwork I would definately request for this.;)

    Has your chartered accountant sister helped with any of the claims.... I thought she was going to help us all on here...;)

    lol, well she didn't end upstaying too long as her son, my nephew wasn't too well, although she did take some copies of my stuff with her and said when she gets time she will look through them, I also shown her this site too...:D , she said she will register and get on here as soon as she can, :D , I do hope so anyway.;)

    Her son suffers a lot with his tonsils, and bless he was so pale yesterday, he is white blonde anyway and poor thing looked like a ghost, she said he was okay leaving in the morning but as the day went on he could hardly talk - poor lad.
