Just got through to them and my case has been assigned an adjudicator at long last and it is the same one as the co-op complaints. Just spoken to him and he only had the file half an hour ago so leave him to it for a while now.

Good so in that case they have not thrown it back to you then ?;) :D
    And so they shouldn't either.

    Phew thats a relief.:T

Now I know its only been a few weeks that I received the last letter about Endeavour which was the acknowledgment, wonder if that was in the same pile as your last one ?
    Just curious........ and anxious:rolleyes:

That is just not fair to go back in the queue !!!
5 months is long enough already !!

They have confused all this for you !

So it seems they will fast track on of the complaints but not them all, yet you still have personal problems etc, which really should include them all.
I have actually heard that they will consider looking at no matter how many complaints you have, that they can still have them all fast tracked, I would see if they can do this for you still.

The other reason why I asked how long has your latest one been in with them is because I was wondering if it was around the same time as my Endeavour one I sent back to them a few weeks back ?

Because if these were in the same pile sort of thing, I am wondering if I will hear if this is going to be passed on them thrown back at me again.
It is now with an adjudicator as of today and they have put my first complaint in and my unfair rebate together. I have not been fast tracked but they have now put this through as the date of the first complaint was actually May of this year and assigned original adjudicator in June. It has been a near on 6 month wait for this but at least it is being looked at now. I told them that in March of next year my 6 years are up and if they cannot look into this then I want to take this to the courts. That helped too.

They did tell me the settlement was correct though and that they are looking into this as I made an appeal. I have bad feelings here. I don't know about the unfair rebate one although my original complaint was unfair rebate and settlement but on one form.
  • GRATEFULLY received, even!

Can you tell I'm working myself into a lather about all of this?

Looking back at the Final response given by Lloyds TSB, here is some things they added, this is so much like everyone elses who have the same problem with them as me:

the policy document made it clear that the cover was optional and asked you to ensure that it met with your requirements. In addition, it explained that you could cancel the policy during the 30 day cooling period without having to pay any premiums.
Alternatively you could cancel anytime afterwards, provided that you gave us 14 days notice.

Having reviewed you details, I have found no evidence to show that we led you to believe you could only have the credit card account if you also took out the Payment Protection Cover.

I should explain that, with regards to being a "Homemaker/unemployed person, you were still eligible for the cover under the Hospitalisation and the Life sections of the policy and could also benefit from the Positive job Solutions.
If your cicumstances changed and you started employment, then you "may" have become eligible for the Unemployment and sickness and Accident sections, as well as the life cover and the Positive Job Solutions.

Full details of the policy's cover and exclusions are given in the policy document, which we would have sent to you when you you took out the Payment protection cover.
    ...................................................................................................
So look like you could get credit then being unemployed. Was this just a monthly payment then and not a loan PPI? Was it cancellable then??

    Morning all,

I'm not sure whether this is the right place to post this, as still getting used to this forum business, but would appreciate your comments.

Basically, I bought a car in September last year through Carcraft, who arranged finance for me. They asked whether I wanted optional PPI, and I agreed after hearing the guy's patter about it all.

Since then, I have been making monthly payments to my finance company for my car, and also paying £56 a month to Creation Consumer Finance for my PPI.

Anyway, upon looking at my documents today, it appears that I am in fact paying towards optional PPI in with my loan payments (it's done as a separate loan to my HP, but I make 1 payment to the company to cover both), so it turns out I've been paying £54 a month to the finance company and £56 a month to Creation for the same thing!

Obviously, I would not knowingly have signed up for this. Have I been mis-sold PPI? What are my chances of rectifying this, and how would I go about it?

Any advice would be greatly received as I'm currently on maternity leave and the extra £56 a month would come in very handy.

    Thanks

    Hi there and Welcome.

So your paying out £110 a month then ?

Is one for the car and the other for the cover ?

Just want to make sure I got it right here.

Have you the paperwork/agreements with these hun?

I would otherwise contact them and request for copies of these, they may charge up to a £1.
I would also request for a written breakdown to see where all this money is going, we can then move on from there.

Maybe someone else will post here to guide you here, hopefully.

Please post anytime for further questions hun, good luck!

    Di.

You certainly sound like you have been missold here TWICE maybe. You need to write to whoever sold the PPI to you at the time of the car purchase.

Just send the first letter and then you have wait 8 weeks for a full and final response to this. Send it recorded delivery and then you have a proof. From the template letter add/delete as many reasons as you can and good luck.

Yes as it seems hun they do sell credit to unemployed.

It came out of the payment every month, on my statements it shows the PPI was added, which was about £35 extra per month or more plus interest just on the ppi.

I explained on the FOS form that I did not receive any policy documents which is true, I cannot even see any in the SAR then its gone 6 years, yet I also told the FOS that if I had been informed on this on the sale of this product, I would not have taken it, to cause further expense, and was told where to tick my form.

I also added on the form that nothing was explained, if it was then I would not have taken it with little money coming in every month.

Yes they have a cancellation period, but I did not know the rights on this due to not received the policy booklet docs, and even wrote to cancel the whole lot when I had settled this, they deny this, and I do have the copy of the letter here too.

Just a thought due to being curious of the Endeavour Unfair rebate, do you think it will do any harm in just emailing to find out at what stage they are at currently ?

Although I do have a feeling its not even been looked over yet to know if they will be looking at it to pass on or not, but I am sure on my last one, after the acknowledgment letter it was about a week after they returned them back to me, I may be wrong and just confused here, as that other one was about mis selling and sent to them in June this year but I'm sure by the end of that same month it was returned back to me then, will see if I can find the letters and paperwork for this.

It could just be though that they still not got to that stage yet due to the higher volume in complaints.

When I was alone with my son I never had no credit of any sort as I had little means of paying this off. I feel they should not have forced you into this when they gave your hubby the card. What we have always done is take one card and put the other as second card holder. The actual card is in my husbands name then as he earns the money. Was the PPI then £35 per month each and every month or just when you had a balance. We never had any applied to any cards ... was it variable then... to cover whatever you had as a balance. ???

I agree with you they should not have sold this to me really.

The payment varied every month, depending on how much was spent on the card, it was so easy, and I will never do it again.

I think the smallest payment of the ppi was £11.50 then it went up from there, this was then added on the min payment due, so for example:
    Payment received £30
    Cardholder PP protection £11.50
Interest at 1.385% per month £20.15

My pp has also come out at £40 alone too !
