Thank you ladies :T
2nd letter completed and ready to be sent via recorded delivery first thing Monday.
Have also put together a letter requesting a copy of calls on CD.
Prepared the SAR letter as well as a full back.

Also had log burner put in instead of open fire thought it might keep fuel costs down:D

Anyway X Factor and Strictly with large glass of wine coming up:rotfl:Hic. going to get my jim jams on early and settle I think. Had a mad do on me again last night about unfair rebates.:eek: . I needed to know how you work them for definate but tried and then after found tiggraes post to me some weeks ago which said there is not definate answer when they go to the FOS. If you win with them then they ask for a fairer rebate and you either decline or accept.

I am going to shake my finger at youYou need to take a big breath and not turn yourself inside out trying to sort these things out.
Had this e mail today from an associate of mine and am putting it hear
OVERWHELMING STRESS.
Sometimes you get thrown challenges where you
think to yourself "I can't cope with this". Even when
you have a positive attitude and know all sorts of
stress management techniques. Sometimes, life
will throw you a curve ball.
I have had one of those 'curve balls' recently A
mind-numbing, gut churning, fear inducing horror
that I felt was completely outside of my domian
of experience and something that would surely
overwhelm me...
Has the challenge gone away... NO.
Am I still overcome by it... NO.
I realised that there were several aspects to the
stressful situation.
1) Those aspects (no matter how minor) that I
could make decisions about and take action
upon.
2) Those aspects that are outside of my control
and upon which I will have to wait to see how
things pan out.
So I took action on the items I could take action
on and I am awaiting events in the areas that are
currently outside of my control.
That improved things a lot, but there was still a
LOT of stress and angst.
When I have a major problem, I tend to turn to the
one person who over the years has never ever let
me down...
Myself.
I asked myself, why was I still feeling such terrible
feelings of stress and panic and helplessness
and my inner self came up with the one true
answer...
It said, in a caring voice...
"Because you are being a selfish, self-centered,
self-indulgent, little twerp"
My voice didn't use the word 'twerp' but the words
that it did use would prevent you ever receiving
this email if I included them.
So I listened to my inner voice and realised that
yes, there was more than a little of self-indulgent
wallowing going on and I had better stand up
straight and get on with things.
Now, that may seem a bit harsh, what about caring
and taking time to recover from trauma... Sorry, but
life is way too short. In my not very humble opinion
the very best thing to do, is to ALWAYS go down
guns blazing, fighting against any kind of adversity
with your every breath.
So the next time you get stressed the THREE
POINT PLAN is:
1) Do what you can.
2) Don't fret over what you can't do.
3) Get on with your life,.
Oh and for the ongoing stress (and yes there is
that) - simply keep doing '1', '2' and '3' over and
over again until you don't have to do it any more
because you have dealt with the challenge.

just a quickie before I send them off, is this the correct SAR letter? Type it all up, sealed the envelope and then thought hold on, is that right :rotfl:
In the first part under the Data Protection Act 1998:
Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.
Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.
If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.
For the avoidance of any and all doubt, I reiterate:
I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).
If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).
Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.
I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.
I enclose the statutory maximum fee of £10.00 to access ALL data held by First Plus about ourselves. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.
You have 40 days in which to comply with this request.
This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.

Sorry for the delay, the in-laws were here.......:eek: , right I will dig out that SAR template for you, you will have to pay £10 cheque payment for this or postal order, but by law then they have to provide you with everything they have on you on your account, give me a min and back soon with a SAR, they have 40 days to get back to you.
You can still try to request for the CD free of charge, but most will charge for this and say you would have to request for a SAR.;)
