    Hi Marshallka

No i have not accepted this offer i was going to speak to them in the morning to say i am not happy and see if i can get a better offer.

You need to let them know that they have "forgotton" to take into account that this was a loan to pay for the PPI and being a loan then this would have had interest on this for the FULL term of your original loan. They have also not taken into account the payment you have ALREADY made against it and if you are going for the misselling here then you want to be put back into the position as if you never had the PPI at all. A much better offer would be in order here.

Hiya Bluemoon, you need to tell them that they have forgotton to include the interest that you would have to pay on the PPI for the full term of the loan and also the repayments you have already made. This PPI was a loan to pay the PPI and therefore cost a lot more in the long run and only covered your loan for 5 years and yet the interest is over the full term. They will rip you off here if you let them. They have also forgot the repayments you have already made against this.

The letter states that it is their final responce so is it worth contacting them?

    Hi there Kazc

I would still send off the reclaim letter now hunni, when the SAR arrives, there just maybe some useful information there for you to enclose with your case if this did go as far as the financial ombudsman service.;)

    Good luck !

    Hi,
i wonder whether someone can help me. i have sent a letter to my cc company about the PPI charges, saying that i believe that they were misold. i have received a letter back saying that i ticked the box on the application form and that i had signed it so they are not prepared to give me any money back.
what should i do now? Can anyone advise, the company is Goldfish. Any replies would be greatly appreciated, thanks

    Hi there
When you say charges, do you mean you have been mis sold the PPI for this or you want to reclaim back the charges ?

If mis sold I would send write back to them and tell them you believe you were mis sold due to (your reasons), and if they do not uphold/refund you all your PPi plus interest paid into this product you will take your complaint to the financial ombudsman service in order with them to investigate this.

If you require further help hun, please just yell where one of us will try to guide you all we can.;)

Have you checked out the section (above - reclaim £1.000's) in the red box, there is info on that link about being mis sold PPI, reasons and a template link, to help you through this.

Did you actually tell them on your first letter that you believe you were mis sold?

    Cheers

    Thanks Di,
This may be a silly question but do you go for an unfair rebate & misselling?

If we didn't have any luck would we still get the £447.00 rebate they offered us or would we lose it ? Should we reply to the rebate offer letter as we haven't as yet ?

It worries me that we are going to be left with nothing as it's already cost us a fortune!!

ok as you guys may remember i'm just about to sent a claim off to halifax, but reading some posts on here i'v remembered that this loan helped to play off another halifax loan. this is the letter i was going to send off, could i add the address and date where i took out the old loan ( don't have old paper work) to the letter? or do i need to send two letters? thanks mac

    Re: Account number:
    Dear Sir,

I purchased the above policy from you in June 2007 but now believe that I was mis-sold this policy for the reasons detailed below. As such I wish to inform you of my decision to cancel the Credit Protection Insurance sold with the above loan.

At the time it was taken out I consider the policy was not fully explained to me, in that

It is a single premium policy, i.e. it is in effect a loan on top of the original loan. If this had been properly explained to me at the time I would not have taken the policy.

It was not properly explained to me that there were (and remain) alternative policies available - at much less cost

Unless you can satisfactorily justify to me that the policy was fair and reasonable I am requesting a full refund of all premiums, and subsequent interest on these payments, that I have paid to date. As I believe I have been deprived of this money I also expect 8% statutory interest, the amount a court would award, to be added to each payment made.

I look forward to a full and prompt response to this letter and for the matter to be concluded within eight weeks or I shall be contacting the Financial Ombudsman to investigate my complaint.

    Yours faithfully,

    Hi there hun
I would continue to write to them anyway and maybe you could mention that this was to pay off the other loan where you belive you were mis-sold on both of these loans due to your reasons.

Meanwhile request a copy of the agreement of the first loan, they will supply this to you either free of charge or maybe charge you a £1 for this.

Is this local to where you live ? It maybe quicker to call in there.

You will not actually need any details as such to continue, but it will come in handy anyway, but still send off your letter and they do tend to send back any agreements with the first letter anyway, just as long as you add your name, addresss at the time of taking out the loan, and date of birth.

They should know about the first loan anyway but as I said get that letter off and request for the copy of the agreements.

    Good luck !
Give us a yell if you require further info.;)

ok i'v just been on my Credit Report there could be another halifax loan to claim on! plus a halifax Second mortgage (secured loan) plus a nothern rock unsecured loan. all are payed off but one. i'v got no paper work as thay go back to 27/07/2001. do you think i could start writeing letters or get copys of the paper first? if so how can i get copys?

    thanks again mac

As mentioned above, yes get those letters in, everything else can follow.
And to get hold of the most needed paperwork ask them all for copies of the agreements, which maybe free of charge if not £1 each, also for any written breakdown of the calculations.;)

If they suggest that you need to request for a SAR (Subject Access Request) for ALL your information, let us know as soon as you know so we can get that template letter added on here for you too, but if you go back a few pages you will note this template for a SAR has been added a few times, yet for this they do charge £10, because they must supply you with ALL the information they have on you on your account, which they have 40 days to supply this as from your letter request.

(always send any letters by recorded post).;)

    All the best.
