Hi there Debs and welcome to my world of unfortunately having a loan with EPF as I did but like you had to go back to the brokers to reclaim on this, however I had the loan in 2004 and both the brokers or Endeavour were not covered by anyone such as the FSA or GISC.

When did you take out your loan with the lender hun and is it still active or settled?
    Thanks.

I have just worked it out sorry hun, you had the loan like me in 2004.

They are passing the buck here I'm sorry to say. (they both are).

EPF are lenders and most of the time brokers gets involved from the start to arrange the loan.

I would get back to both and request copies of any information you can gather from them, like copies of the agreement and if you have settled this a written breakdown too to see if you had a fair rebate on this.

I did at first complain to Endeavour about the mis selling, but they wrote back and said to get back to the brokers (mine were Click Finance) I had to do this myself, and these had unfortunately dissolved.

Now going back to Endeavour I am have another complaint now about the unfair rebate-settlement, which was settled in Nov 2005, they were then regulated by the FSA where now I am hoping the Financial ombudsman service will look into this for me, due to this still not being resolved.

I would definately try to get back to who sold you the loan and if I'm correct I think loans.co.uk were covered, I'm sure someone will correct me here otherwise, and it would be them you would have to complain to.

Have you any paperwork at all to back this up hun ?

    Hi there.
I assume this is the first response then hun ?

Okay if so write back and tell them that you are not satisfied with their response and if they do not reconsider your complaint, you will complain to the Financial Ombudsman Service.

Everything you wrote about the mis selling on the first letter, explain them more fully if you can, make it slightly stronger than the first one hun.

Now as soon as you receive the "Final Decision" they should be able to confirm if you can now forward this to FOS.

Is still unsuccessful hun, then get back to us, it will be then to move forward to the FOS.

Just don't give up, these companies are not always easy but keep fighting.;)

We are writing with regards to a loan/PPI that we took out in July 2004 through a broker called “Click Finance Limited” licence number 0506811. We have a complaint against this company in that we were missold our PPI insurance and are trying to get recompensed for this. We wrote to this company and were told that they liquidated in July 2006 so we need to go to the liquidators with the complaint.

Upon further investigation on this business we note that although months before “Click Finance” went into liquidation they had a “non trading company” or should we say a company that did not hold a consumer credit licence as we can see by the register online called “Click Financial Limited” which they then got a consumer credit licence for to trade very similar to the dissolved "Click Finance Limited".

Upon looking into this further we note that the directors are of the same names as the dissolved “Click” and the name is very similar. We then wrote to this company that now trades using their consumer credit licence number 0563957 issued on 22/01/05 to make a complaint for the misselling. They subsequently wrote back to us stating that they had nothing to do with “Click Finance Limited” and that they could not possibly look into a complaint of another company and it would be “unfair on the share holders”. We find this very hard to believe in that they were directors of the same companies but cannot accept complaints about them. I have researched what is known as “Phoenix companies” and we think that some of what we have researched could belong to these companies in mention.

We would like to make a complaint about the companies we have mentioned. We also note that recently they have closed and opened other companies, namely "Click LImited (no licence number yet online)" opening and "Click Loans Services Limited (licence number 0616548)" closing.

We want to make a complaint against the directors of these companies

We have reason to believe they have not acted in a fit and proper manner and want to ask you if you can investigate the goings on in these companies. When this is allowed to happen we as consumers lose out as they close companies down, sometimes to avoid complaints, and then open up new ones (or use the old ones that they have registered and just get a CCL). It’s not right and certainly not fair practice.

Needs tweaking again but will do online when i can look back over things in a min

thank you for your quick reply i have just wrote a letter to loans co uk and to epf to tell them i am sick for their lies and that i wouldnth be taking no more rubbish i have requested a copy of my agreement with both of them and told them i am going straight to the fininacial ombusdman ,i cant believe they are winding me up so much and wouldnth accept they are wrong .
i have just looked up and they have been fined £1,0555 from the fsa surely i cant be wrong in my situation te reason i feel they have mis sikd my policy is because they said i coulnth have the loan without the ppi and that i have to pay a single preuim but it would be added to the loan .
i am so so digusted i am been treated like this ,will post another when i get the relevant info and agreement paperwork from loans co uk and epf for more advice many thanks

Okay there is this one here:

    Dear

I refer to your recent email regarding your complaint against Click Finance Ltd and recap our previous correspondence. The company has been wound-up and we referred you to the liquidators with regard to your claim. We have been instructed by the Liquidator to take this action whenever there is a query concerning Click Finance Limited as we no longer have any legal capacity in that company and are therefore not able to make any settlement offers on its behalf.

You now appear to be asking Click Financial Ltd to settle a complaint on behalf of another company for which it holds no liability. I am sure that you will appreciate that such an action by management would be unfair on the shareholders of Click Financial Limited and improper.

I would additionally state, however, that Click Finance Limited has never had to settle or recompense a customer for miss-selling and we have no evidence that it miss-sold in this circumstance. Your claim is that you have been miss-sold a Payment Protection Insurance policy but according to the copy letters you have provided, this policy was sold to you in 2004 and you redeemed the associated loan in 2005. We are therefore unable to understand why you did not make a complaint at that time and have waited for almost three years before raising this issue.

I have noted your comments about Click Financial Ltd being a phoenix company and would respectfully point out that you are mistaken in this assumption. The company was actually incorporated before Click Finance Ltd and has always traded in its own right.

My understanding is that Click Finance Ltd was not a member of the GISC.

Regarding the query you raised, any correspondence with Mr Teague should be addressed to this office. I appreciate that this email is not the response you would have liked but nevertheless we feel this is the correct response given the circumstances

    Yours sincerely
Di, send a copy of this as well.

We have also noted that this may be happening again with the two companies below.

Click Ltd and closure of Click Loans.
