    Final point as I think this thread has been done to death. We have been conditioned into getting "too good to be true" bargains with all the DFS adverts (OMG it might end this friday - it was supposed to be Monday, but thank goodness they gave us a few more days to snap up all the bargains) :rotfl:


    Fair enough. I guess what I was trying to say is that, yes, a mis-price is against the law, but the remedy to correct that is to either refund the money or supply the good. A court would see that a refund is fair and reasonable and so would not seek Argos to do anymore than that. You could possibly push it and get Argos to supply the TV at .49p but I just cannot see anyone convincing the court otherwise.

    As Argos have made a refund then this is their remedy/compensation to the situation. I guess for £30 it's worth taking it to court but the court will expect to see that both parties have tried to resolve this amicably before getting to court.

    It was noted recently that Inland Revenue may be prevented from seeking repayment of over paid child tax credit as the courts felt it unfair and unreasonable to punish citizens who were merely doing what was asked of them - and IR mistake is their own (however they are contesting it so can't really use that as a basis of argument either!!)

    People will be able to complain about the fact that ARGOS have several times been found to be mispricing goods, which is an offense.
    They will also be able to complain that effective procedures were not in place to prevent the situation that resulted from the misprice.
    They will also be able to complain that ARGOS's on T&C's were not carried through.


    That's what they can complain about if they want to.

    If you really want to complain, complain to your local Trading standards, particularly if this is not the first time you have come across a misprice by ARGOS.
    They might not do anything other than note the complaint, but if a misprice occurs they are more likely to do something the next time.

  • I honestly can't believe some of the people posting to this thread. Surely it's common sense that a £350 TV being sold for 49p is a pricing error? How thick have you got to be to go ahead and order the bloody thing? It's patently obvious they're not going to honour the transaction, and no judge in the country will ever force them to do so, so why put yourself in a position where you're a fiver out of pocket and having to go through all the hassle of trying to get it refunded?

    I cringed at some of the legal comments. There was a bloke earlier who said he'd contacted his student union and was receiving advice from their legal expert. Oh please, get real. Stop being so bloody melodramatic. If you really HAD got legal advice then you would've known that you've got no real legal recourse whatsoever (something that Argos also knows).

    I've got no sympathy for people who're five pounds down through their own stupid fault. I say good on Argos for making interest off the backs of 10,000 grasping cheapskates with only a couple of brain cells to rub together between the lot of them.

    I do realise people did see this as a too good to be true bargain and the greed monster took over and they foolishly paid for the TV, but this doesn't justify your over the top comments on a site that is supposed to help you save money or in your words a 'grasping cheapskates' site!!!

    If, as it seems you have a problem with 10,000 grasping cheapskates then why bother posting on a Money saving site!!!

    Is it because you are trying to find a bargain and possibly join the ranks of GRASPING CHEAPSKATES!!!

  • Listen, I love a bargain as much as the next guy, but there has to be some element of common sense and a line drawn when you say to yourself "this is just ridiculous". If you haven't got £5 to chuck away, and you can see that Argos are never going to send the goods, then why put yourself in a position where you're going to be a fiver down for a few weeks while you wait for a refund?

    Personally I think most people bought the TV purely so they could kick up a stink and have something to moan about. The British love a good whinge.

    I'm still chuckling away at the thought of a load of 16 year olds angrily instructing their solicitors to commence class action proceedings against Argos. Or should that be Class 4B proceedings....

    Absolutely right but I couldn't be bothered to type the whole title!!!

    I do think too many people have been watching a touch too much television or reading one too many John Grisham novels and now proffess to be armchairs solicitors.

    Common sense is indeed a good tool and should be used wisely.

    I couldn't believe it when I got a pretty smart printer that was reduced by 80%. It was a misprice that I thought was a sale price, but thanks Index.

    Same goes for bottles of wine that were priced so ambiguously, I believe I got a few crates for free. Thanks again Tesco :)

    Whilst 49p does seem a bit on the cheap side for a telly :rolleyes: maybe it's worth remembering the motto of this site?

    It's just a thought by the way. :)

    No email from Argos, No letter and no refund!

    Might give them a bell on the 21st sep if not heard anything by then - not sure what else to do - only ordered the one tv - have I slipped throught the net? (Yeah right! LOL!)
