Eagle_1 about going to court, yes, i have a claim form which im in the process of filling in to take this further. I have spoke with legal people who have sent the form and await its return to start proccedings. Once and for all this may then be sorted out as its such a grey area. It doesnt cost me either as its extra legal cover i take out with my insurance to cover disputes like this.0

Eagle_1 wrote:Will people really take them to court ? See I wouldnt because I know that a big retailer like them are gonna win hands down, surely.
Well the big companies do sometimes lose - as with the Mac Donalds case. However it took over the "little people"' lives for over 10 years.

IT and e-commerce legal site pick up on story. Taking the line that terms and conditions can be used as cover.
Argos makes no mistake with 49p TV
http://www.out-law.com/page-6079"The key is to address pricing errors in the terms and conditions, to make sure these conditions are accepted by customers when they order and to send an order acknowledgement that doesn't undermine that protection, according to Robertson. And this is what Argos did."0 -
harryc wrote:as yet i havent heard one single argument that justifies the removal of money from my credit card by homebase for a product that they have no intention of delivering to me....
to say its an automated system is isnt good enough ....
at this moment in time i am left owing my credit card money ...simple as that ..
forget about what homebase/argos may do in the future ..I am left out of pocket and that is simply wrong ....and the fact that they are now going to reimburse what they have taken ..big deal i say thats really good of them to give me my money back ......
the mistake was thiers not mine

You're left out of pocket through your sheer greed, you knew the price was incorrect and you took a gamble, it didn't pay off. It's PAC not PAC Code, it's MAC not MAC Code, it's PIN not PIN Number, it's ATM not ATM Machine, it's LCD not LCD Display, it's DVD not DVD disc... It's no one not noone, It's a lot not alot, It's got not gotten... Panini is the plural of panino - there is no S!!(OK my English isn't great, the sciences, maths & IT are my strong points!)0 -
Argos may now be taken to court by lawyers acting for buyers. Click here
Interesting that one of the most experienced and respected e-journals, Silicon.com, raises some questions about this slip up.Click here
The matter may not, therefore, be as straight forward as many e-comm lawyers have suggested. A consumer focused investigation which also looks at the fact that Argos are reported to have harvested 10,000 valuable up to date email addresses of online shoppers out of this error might well be useful.0 -
Someone in the original thread did advise to tick no correspondence which sounded a good idea so hopefully most mse'rs will have done that and argos cant benefit
Is it worth filling in the form from this message? who are these people 'the claim room' and are they legit? Help please0
